, TheAgreementforNo. 2,theSignAgreement, canbereleasedassoonas anappropriate signpermitisobtainedandalltherequiredfeesarepaid. Throughsomeinadvertenterroronourpart, asignpermitwasneverissued. This is averysimplerequirement. Youwillneedtohavesomeonesubmitfor asignpermit,wewillsignitoffandcollecttheapprapriatefees,andthenwe willreleaseyourPublicFacilitiesFeeAgreementforthatarea. Thatshad clearupallofthePublicFacilities FeeAgreementsthatareonfilewiththe City to be released.
The followingthreeagreementscannotbereleasedatthistime.

2. AgreementtoPayFeesRequiredbyGrowthManagementSystem, datedApril13,1987-Recorder'sFileNo. 87-299160, PC-587,Spa Exercise Room Addition, 1,720 square feet
3. AgreementtoPayIncreasedFeesforDevelopmentManagement System, datedFebruary21,1986-Recorder'sFileNo. 86-082699, CUP-258, PC-85-336, 160 Hotel Units
TheseagreementsarearesultoftheCity'sFmplementationoftheGrawth ManagementPlan. Allapplicationsthatweresubmittedsubsequenttothe adoptionoftheGrowthManagementPlanwererequiredtosignanagreement topayanyandallfuturefeesassociatedwiththeGrowthManagementPlan.
Therearetwo feesthatarekeepingtheseagreementsframbeingreleased atthistime. First, isanidentifiedfee,whichisan inWeasefrcm2.5to3.5'
percentbasedonthepermitvaluationoftheconstructionthatozurredinthe recentadditionsandl;emodelingofthefacility. ?hisonepercentwillbebilled withinthenextthirtydays. Thesecondfee,whichhasnotyetbeen determined, istheccamnercialandindustrial fairshareofexistingdeficiencies L inthesouthCarlsbadarea. Thesearecont~entliabilitiesassoc iatedwithall applicants/developerswhosignedagreementstopayanyandallfuturefees. Theagreementwasamethodbywhichdevelopmentcould occur priortothe establishmentof fees. Applicantswhochosenottosignthefuturefee agreements,wouldI?otbeissuedanypermitsuntilallofthefeeswere establishedsotheycculdpaytheirfairsharetomitigatedeficienciesintheir Zoneor QuadrantoftheCity.
