SUBJECT: CD 2017-0016 -LEGOLAND HOTEL CALIFORNIA (SDP 96-14(C)/CDP 96-16(C) (DEV2016-
0025)
The City Planner has completed a review of your application for CD 2017-0016, (APN: 211-100-09-00)
which is a modification to SDP 96-14(C)/CDP 96-16(C)-Legoland Hotel California, an approval for a hotel
with restaurant. The proposed modifications include:
• Enclose a portion of an existing, covered outdoor dining patio, thereby converting 200 of 270
existing outdoor dining seats to indoor seats, leaving an existing patio with 70 outdoor dining
seats.
• Construct a 1,256 square foot addition to the hotel restaurant's existing kitchen.
• The enclosure represents an addition to the restaurant that, when combined with the kitchen
addition, totals 5,492 square feet and does not exceed the height of the hotel.
In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings
must be made:
1} No project condition, feature, facility or amenity is changed or deleted that had been considered
essential to the project's design, quality, safety or function in that the overall seating capacity
will not be changed, and the kitchen addition will not interfere with operations and pedestrian
circulation associated with the hotel or theme park entrance.
2} The request represents an upgrade in overall design features and/or materials and improves upon
the project's compatibility with the surrounding neighborhood in that enclosing a portion of the
outdoor dining patio with materials and a design that matches the existing building will be an
upgrade over the existing canopy cover.
3) The proposed revision does not change the density or boundary of the subject property.
4} The proposed revision does not involve the addition of a new land use not shown on the original
permit.
5) The proposed revision does not rearrange the major land uses within the development.
6) The proposed revision does not create changes of greater than ten percent provided that
compliance will be maintained with the applicable development standards of the Carlsbad
Municipal Code, in that the 5,492 square foot addition represents a 9.3 percent increase to the
existing hotel's building coverage, and the height of the additions is 15 feet for the main roof
and 24 feet for architectural features, which is well below the 401-611 height of the existing hotel.

7) The proposed change will not result in any significant environmental impact, and/or require
additional mitigation.
8) The proposed change would not result in any health, safety or welfare impacts.
9) There were not any major issues or controversies associated with the original project which would
be exacerbated with the proposed change.
10) The proposed change would not be readily discernable to the decision makers as being
substantially different from the project as originally approved in that the outdoor dining patio is
existing, the enclosure matches the style, materials and colors of the existing hotel, and the
kitchen addition is located at the rear of the enclosure and will appear as a continuation of the
building.
After careful consideration of the circumstances surrounding this request, the City Planner has
determined that the application qualifies for a consistency determination with the approved permit and
therefore, approves the changes to the project based on Planning Division Administrative Policy No. 35.
