The City Planner has completed a review of your application for a Consistency Determination, CD 2017-
0020, which is a modification to the Uptown Bressi Retail Center located at the southwest corner of
Palomar Airport Road and El Fuerte Street, north of Gateway Road, and east of Colt Place.
The proposed modifications to the retail center will occur on the following Sheet Numbers:
Sheet ASl:
• Add parking stalls behind Buildings A and B
• Add parking stalls in front of Building C
• Revise parking layout between Buildings C and H
• Add decorative festoon lighting between Buildings E and Data minimum height of 14 feet above
the street surface
Sheet AS2:
• Revise the roof plan layout to reflect the building changes at Buildings C and G
Sheet AS3:
• Revise site section Building D to reflect the Building D tower change
Sheet A2:
• Floor plan E: add additional storefront on the west-facing elevation consistent with the center's
architecture
• Floor plan F: revise the location of the mechanical and fire riser rooms in order to add additional
west-facing storefront consistent with the center's architecture

• Elevations a, b, d, e & g: note the height of the festoon lighting above finish floor
• Elevations band d -Building D: revise northwest tower height to 35 feet similar to other tower
elements within the center
• Elevation d-Building D: revise southwest tower height to 30 feet similar to other tower elements
within the center
• Elevation g -Building E: add storefront at the northwest elevation consistent with the center's
architecture
• Elevation h -Building F: add storefronts at the northwest and southwest elevations consistent
with the center's architecture
• Elevations g and h -Buildings E and F: add minor fa~ade changes to accommodate the addition
of the additional storefronts
Sheet AS:
• Elevation b-Building G: add tower element to northwest elevation at a height of 35 feet similar
to other tower elements within the center
• Elevation f-Building G: add tower element to northwest elevation at a height of 35 feet similar
to other tower elements within the center
In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings
must be made:
1} No project condition, feature, facility or amenity is changed or deleted that had been considered
essential to the project's design, quality, safety or function in that the overall number of parking
spaces provided will meet the minimum number {491 spaces) required, and the addition of
parallel parking spaces behind the proposed market and pharmacy will not interfere with truck
circulation.
2} The request represents an upgrade in overall design features and or materials and improves upon
the project's compatibility with the surrounding neighborhood in that minor fa~ade changes to
accommodate the additional storefronts matches the approved design theme of the center and
represents an overall upgrade.
3} The proposed revision does not change the density or boundary of the subject property.
4) The proposed revision does not involve the addition of a new land use not shown on the original
permit.
5) The proposed revision does not rearrange the major land uses within the development.
6} The proposed revision does not create changes of greater than ten percent provided that
compliance will be maintained with the applicable development standards of the Carlsbad
Municipal Code.
7} The proposed change will not result in any significant environmental impact, and/or require
additional mitigation.
8} The proposed change would not result in any health, safety or welfare impacts.
9} There were not any major issues or controversies associated with the original project which would
be exacerbated with the proposed change.

10} The proposed change would not be readily discernable to the decision makers as being
substantially different from the project as originally approved in that the revised tower height to
Building D and added vertical architectural relief (tower) to Building G is similar in height and
design to other tower elements within the center.
After careful consideration of the circumstances surrounding this request, the City Planner has
determined that the application qualifies for a consistency determination with the approved permit and
therefore, approves the changes to the project based on Planning Division Administrative Policy No. 35.
A signed copy of the approved plan is attached for your records.
