SUBJECT: CD 2017-0022 (DEV00072) -CALAVERA HILLS COMMUNITY PARK GATEWAY PROJECT
(CUP 266X2[A])
The City Planner has completed a review of your application for a Consistency Determination (AP N's: 167-
101-07, 08, 34 and 35), which is a modification to CUP 266X2{A). This CUP was approved for the
development of a 16.55 acre community park located between Carlsbad Village Drive to the north,
Glasgow Drive to the east and Tamarack Avenue to the west and southwest. The proposed modifications
include the development of a 0.52 acre vacant site adjacent to the park with the following amenities:
• A looped walkway with exercise stations,
• fabric shade structures,
• covered picnic area with seating,
• barbeque area,
• park benches,
• monument sign,
• decorative lighting,
• passive turf area, and
• perimeter landscaping.
In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings
must be made:
1) No project condition, feature, facility or amenity is changed or deleted that had been considered
essential to the project's design, quality, safety or function in that the addition of 0.52 acre parcel
contiguous to the existing 16.55 acre park would add additional park area and amenities and
will not interfere with the operation and design of the existing park.
2} The request represents an upgrade in overall design features and or materials and improves upon
the project's compatibility with the surrounding neighborhood in that the proposed park features
would be an upgrade to the existing vacant lot and improve the compatibility with the
surrounding neighborhood.
3} The proposed revision does not change the density or boundary of the subject property in that
while the addition of 0.52 acre does alter the park boundary1 this finding still can be made as
the revision is consistent with Carlsbad Municipal Code (CMC} Section 21.42.140.100c. This
section states1 "park Improvements that do not add a new land use to the master park site plan
or increase the maximum anticipated site area or building area for a use by more than twenty
percent of what is anticipated on the master park site plan may be approved administratively
by the city planner. 11

4) The proposed revision does not involve the addition of a new land use not shown on the original
permit in that the proposed uses are consistent with the existing park uses and would not include
new land uses.
5) The proposed revision does not rearrange the major land uses within the development in that the
project would increase the park area by 3.1% and would not rearrange any of the existing park
uses.
6} The proposed revision does not create changes of greater than ten percent provided that
compliance will be maintained with the applicable development standards of the Carlsbad
Municipal Code in that the addition of 0.52 acre increases the park size by 3.1%; furthermore,
the proposed improvements will be in compliance with the applicable development standards
of Carlsbad Municipal Code Chapter 21.33, Open Space Zone.
7} The proposed change will not result in any significant environmental impact, and/or require
additional mitigation in that the proposed project would be located on a previously graded
parcel and the uses would be passive compared to the existing active park; therefore, the project
would not result in any significant environmental impacts or require additional mitigation
measures.
8} The proposed change would not result in any health, safety or welfare impacts in that the
proposed park uses are compatible with and similar to those at the existing park, are passive in
nature, and represent a logical extension of the park in a manner compatible with the nearby
residences.
9} There were not any major issues or controversies associated with the original project which would
be exacerbated with the proposed change in that there were no major issues or controversies
associated with the original park approval {CUP 266}; furthermore, a r~cent City Council-
accepted Needs Assessment and Comprehensive Action Plan identified the proposed uses as
desirable to the community.
10} The proposed change would not be readily discernable to the decision makers a$ being
substantially different from the project as originally approved in that the project will improve the

After careful consideration of the circumstances surrounding this request, the City Planner has
determined that the application qualifies for a consistency determination with the approved permit and
therefore, approves the changes to the project based on Planning Division Administrative Policy No. 35.
