The City Planner has completed a review of your application of a Consistency Determination, CD 2018-
0003 - CARLSBAD OAKS NORTH LOT 8 (APN 209-120-07-00), which is a modification to SDP 16-10 for the
development of a 168,000 square foot multi-tenant warehouse building on a 13 2 acre lot
After careful consideration of the request, the city planner has determined that the request meets all of
the findings below and APPROVES this request The proposed modifications include
• Demolition of an existing retaining wall along the north side of the project site to create an
additional 59 compact parking spaces
• Construction of a two-tiered retaining wall, each tier six feet tall and four feet-two inches
apart, to accommodate the additional parking spaces
• Revised onsrte grading consisting of approximately 2,300 cubic yards of export
• Landscaping shall be planted in front of, between and above the wall tiers on the uphill
manufactured slope
In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings
must be made
1) No project condition, feature, facility or amenity is changed or deleted that had been considered
essential to the project's design, quality, safety or function
2) The request represents an upgrade in overall design features and or materials and improves upon
the project's compatibility with the surrounding lots m that the two-tier retaining wall will use
top quality building materials that blend with the surrounding environment to the^ extent
possible
3) The proposed revision does not change the density or boundary of the subject property
4) The proposed revision does noTinvolve the addition of a new land use not shown on the original
permit in that there are no proposed changes to the permitted 168,000 square foot multi-tenant
warehouse approved under SDP 16-10
5) The proposed revision does not rearrange the major land uses within the development
6) The proposed revision does not create changes of greater than ten percent provided that
compliance will be maintained with the applicable development standards of the Carlsbad
Municipal Code m that the wall heights comply with standards and there will be an increase, not
a decrease, in parking spaces

7) The proposed change will not result in any significant environmental impact, and/or require
additional mitigation in that the grading into the existing manufactured slope will still maintain
a 2:1 slope at the steepest point
8) The proposed change would not result in any health, safety or welfare impacts In that the grading
and tiered walls will meet all civil, structural and building code requirements
9) There were not any major issues or controversies associated with the original project which would
be exacerbated with the proposed change in that the wall will be constructed on the north side
of the lot, which Is behind the permitted multi-tenant building, and will not be visible from
public views
10) The proposed change would not be readily discemable to the decision makers as being
substantially different from the project as originally approved
After careful consideration of the circuniistances surrounding this request, the City Planner has
determined that the application qualifies for a consistency determination with the approved permit and
therefore, approves the changes to the project based on Planning Division Administrative Policy No 35
/
Please note that the proposed revisions may necessitate issuance of a grading permit, building permit
and/or approval of final landscape plans Approval of this request shall not excuse compliance with all
applicable sections of the Zoning Ordinance, the Westfield Carlsbad Specific Plan, and all other applicable
City ordinances
