The City Planner has completed a review of your application for a Consistency Determination, CD 2018-
0007, which is a request to review the proposed project's compliance with the Site Development Plan SDP
86-ll(A).
After careful consideration of the request, the City Planner has determined that the request meets all of
the findings below and APPROVES this request. The proposed project includes the renovation and
expansion of an existing outdoor dining area at the Plaza Paseo Real shopping center located at 6941 El
Camino Real (APN 215-050-75). More specifically, the outdoor dining area and plaza are located on the
lower level of the shopping center, between the Tin Leaf and Daphne restaurants, at the northwest corner
of El Camino Real and Aviara Parkway. The remodel includes the following improvements:
• Remove water fountain, vinyl awnings, table/chairs, patio railings and patio furniture and replace
with a new trellis and shade structure over outdoor seating areas with new outdoor dining
furniture and a firewall feature
• Landscape renovation, including the removal of several palm trees and the addition of new trees,
landscape planters and a planter wall around the patio
• Re-routing of accessible path of travel
• Replacement of monument sign at the corner of El Camino Real and Aviara Parkway (separate
sign permit required)
• Addition of 3,635 square feet of concrete to expand the plaza, resulting in 2,760 square feet of
new outdoor dining area.
• Addition of a low, decorative wood fence around the perimeter of the patio area
• New outdoor lighting
• Define the boundaries for the sale of alcohol (7,934 square feet)
In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings
must be made:
1} No project condition, feature, facility or amenity is changed or deleted that had been considered
essential to the project's design, quality, safety ar function in that the expanded outdoor dining area
and plaza remodel are consistent with SOP 86-11(A) and the El Camino Real Corridor Guidelines,
which require o color palette and materials that complement a Spanish or Mediterranean
architectural theme.

2) The request represents an upgrade in overall design featur~!rbnd or materials and improves upon the
project's compatibility with the surrounding neighborhood in that the remodel to the plaza and
expansion of the outdoor dining area propose an updated theme which complements the Plaza
Paseo Real shopping center and surrounding neighborhood.
3} The proposed revision does not change the density or boundary of the subject property.
4} The proposed revision does not involve the addition of a new land use not shown on the original permit
in that the proposed project includes a request to expand an existing outdoor dining area.
5} The proposed revision does not rearrange the major land uses within the development.
6} The proposed revision does not create changes of greater than ten percent provided that compliance
will be maintained with the applicable development standards of the Carlsbad Municipal Code in that
the addition of 2,760 square feet of outdoor dining area, which results in the requirement for an
additional 28 parking stalls, can be adequately parked since the 27-acre shopping center has 153
surplus parking stalls. Further, no additional building area is proposed.
7) The proposed change will not result in any significant environmental impact, and/or require additional
mitigation.
8} The proposed change would not result in any health, safety or we/fore impacts in that the Police
Department has approved the area proposed for the sole of alcohol.
9) There were not any major issues or controversies associated with the original project which would be
exacerbated with the proposed change.
10) The proposed change would not be readily discernable to the decision makers as being substantially
different from the project as originally approved in that the remodel to the plaza and the expansion
to the outdoor dining area are consistent with SDP 86-11{A).
After careful consideration of the circumstances surrounding this request, the City Planner has
determined that the application qualifies for a consistency determination with the approved permit and
therefore, approves the changes to the project based on Planning Division Administrative Policy No. 35.
