'li · 2. 0 · \ [ 8FILE COPY SUBJECT: CD 2018-0013 (DEV15058)-PACIFIC WIND Ccityof Carlsbad The City Planner has completed a review of your application for Consistency Determination CD 2018-0013, which is a modification to SDP 15-18/CDP 16-04/MS 16-01-PACIFIC WIND, a request for the demolition of 44 residential units and the construction of a 93-unit apartment (92 affordable units) development, including a development standards modification, and a street abandonment for a portion of Harding Street near the intersection of Carol Place, in the Residential-Density Multiple Zone and within Local Facilities Management Zone 1. After careful consideration, the City Planner has determined that the request meets all the findings below and APPROVES this request. The proposed modifications include: • Reduction of affordable housing units from 93 to 87 units (six-unit reduction). • Removal of the third floor at Building 4. • Lot line adjustment to accommodate the removal of six units while maintaining the minimum required density of 23 dwelling units per acre (du/ac). In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings must be made: 1) No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function in that the proposed changes are not essential to the project's design, quality, safety or function. 2} The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood in that proposed changes are a result of the developer's agreement with the surrounding neighbors to mitigate potential negative impacts to adjacent properties in the neighborhood. 3} The proposed revision does not change the density or boundary of the subject property in that the reduction in unit count and subsequent reduction in lot area maintains a density of 23 du/ac as previously approved. 4) The proposed revision does not involve the addition of a new land use not shown on the original permit in that the proposed land use remains residential as originally approved. Community & Economic Development Planning Division I 1635 Faraday Avenue Carlsbad, CA 92008-7314 I 760-602-4600 I 760-602-8560 f I www.carlsbadca.gov CD 2018-0013 (DEV15058) -PACIFIC WIND August 20, 2018 Pa e 2 i 5) The proposed revision does not rearrange the major land uses within the development in that the proposed land use remains residential as originally approved. 6} The proposed revision does not create changes of greater than ten percent provided that compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code in that the number of units is reduced by approximately seven percent, and the proposed changes to the project comply with all applicable development standards of the Carlsbad Municipal Code. 7) The proposed change will not result in any significant environmental impact, and/or require additional mitigation in that the proposed project is not substantially different than what was previously approved. 8} The proposed change would not result in any health, safety or welfare impacts in that the proposed project is not substantially different than what was previously approved. 9) There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change in that the proposed revisions to the project are a result of an agreement between the developer and surrounding neighbors. 10} The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved in that the proposed project is nat substantially different than what was previously approved. Therefore, the City Planner has determined that the application qualifies for a consistency determination with the approved permit and approves the changes to the project based on Planning Division Administrative Policy No. 35. Additionally, this Consistency Determination is approved provided that a covenant of easement is recorded on the parcel map to allow for cross lot drainage, shared storm water quality best management practices, vehicular access and parking between Parcel 1 and the effected portion of Parcel 2 consistent with the covenant of easement notes on sheet SP-1.
