SUBJECT: CD 2018-0017 {DEV16032) -PEELLE RESIDENTIAL ADDITION

The City Planner has completed a review of your application for a Consistency Determination, CD 2018-
0017, which is a request to reduce the scale of the project approved pursuant to Coastal Development
Permit CDP 16-24. After careful consideration of the request, the City Planner has determined that the
request meets the findings below and APPROVES this request.
Specifically, the revised project includes the elimination of the pool in the rear yard and the reduction in
area for the addition.to the single-family home from 965 square feet to 358 square feet. The architectural
style of the addition is also proposed to be modified to a design which is more complementary to the
Contemporary Ranch style of the existing home. The address of the site is 2441 Buena Vista Circle.
In order for o Discretionary Permit Consistency Determination to be approved, all of the following findings
must be made:
1) No project condition, feature, facility or amenity is changed or deleted that had been considered
essential to the project's design, quality, safety or function in that the change in architectural
style of the addition complements the Contemporary Ranch design of the existing single-family
home.
2} The request represents an upgrade in overall design features and or materials and improves upon
the project's compatibility with the surrounding neighborhood in that the change in architectural
style of the addition from Modern/Contemporary to Contemporary Ranch complements the
design af the existing single-family home and the surrounding residential neighborhood.
3} The proposed revision does not change the density or boundary of the subject property.
4} The proposed revision does not involve the addition of a new land use not shown on the original
permit.
5} The proposed revision does not rearrange the major land uses within the development.
6} The proposed revision does not create changes of greater than ten percent provided that
compliance will be maintained with the applicable development standards of the Carlsbad
Municipal Code in that the revised design results in a decrease in the addition's square footage
from 965 square feet to 358 square feet and a reduction in height from 17'-6" feet to 14 feet.

7) The proposed change will not result in any significant environmental impact, and/or require
additional mitigation.
8) The proposed change would not result in any health, safety or welfare impacts.
9} There were not any major issues or controversies associated with the original project which would
be exacerbated with the proposed change.
10} The proposed change would not be readily discernable to the decisioo makers as being
substantially different from the project as originally approved in the proposed changes represent
an enhancement in the design since the original approval entailed changing the architectural
style from Contemporary Ranch to Modern/Contemporary. The proposed changes complement
the existing architectural style. Further, the project is not required to comply with design
guidelines of a Master Plan or Specific Plan.
After careful consideration of the circumstances surrounding this request, the City Planner has
determined that the application qualifies for a cons(stency determination with the approved permit and
therefore, approves the changes to the project based on Planning Division Administrative Policy No. 35.
