The City Planner has completed a review of your application for a Consistency Determination, CD 2018-
0024, which is a request to modify the approved design for Review Permit RP 15-16 and Coastal
Development Permit CDP 15-37 to comply with the Building Code as follows:
1. Reduction in the retail area from 1,105 square feet to 1,008 square feet to accommodate a
larger building footprint for the elevator and an electrical control room.
2. Modification in the design of the north elevation to comply with the Building Code. The
changes include the addition of large expanses of wood composite and stucco. The addition
of these elements will screen the exterior stairways and walkways as viewed from Carlsbad
Village Drive.
3. Addition of electric transformer at the project frontage (northwest corner of the lot).
4. Reduction in square footage of the common area and private decks from 4,465 square feet to
2,555 square feet to address Building Code requirements.
After careful consideration of the request, the City Planner has determined that the request meets the
findings below and APPROVES this request.
In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings
must be made:
1) No project condition, feature, facility or amenity is changed or deleted that had been considered
essential to the project's design, quality, safety or function in that the project remains consistent
with the development standards of the Village Master Plan, including height, setbacks and open
space.
2) The request represents an upgrade in overall design features and or mate.rials and improves upon
the project's compatibility with the surrounding neighborhood in that the addition of the wood
composite siding and stucco to the north elevation screens the exterior walkways and railings
which would otherwise be visible from Carlsbad Village Drive.
3) The proposed revision does not change the density or boundary of the subject property in that no
units are proposed to be added or eliminated.
4) The proposed revision does not involve the addition of a new land use not shown on the original
permit in that no changes are proposed to the land uses.
5) The proposed revision does not rearrange the major land uses within the development in the
layout of the floor plan for the retail and the residential units remains the same.
6) The proposed revision does not create changes of greater than ten percent provided that
compliance will be maintained with the applicable development standards of the Carlsbad

Municipal Code in that the reduction in the deck area is required to comply with the Building
Code. The resulting common and private open space, 2,555 square feet, complies with the
Village Master Plan that requires a minimum of 20% or 1,383 square feet of open space for the
project. No changes are proposed to the setbacks or the building height.
7} The proposed change will not result in any significant environmental impact, and/or require
additional mitigation.
8} The proposed change would not result in any health, safety or welfare impacts in that the changes
are proposed to comply with the Building Code.
9) There were not any major issues or controversies associated with the original project which would
be exacerbated with the proposed change.
10} The proposed change would not be readily discernable to the decision makers as being
substantially different from the project as originally approved in that the changes to the north
elevation represent an improvement since the large expanse of composite wood paneling and
stucco will screen the long expanses of walkways, exterior railings and balconies that would
otherwise visible from Carlsbad Village Drive.
After careful consideration of the circumstances surrounding this request, the City Planner has
determined that the application qualifies for a consistency determination with the approved permit and
therefore, approves the changes to the project based on Planning Division Administrative Policy No. 35.
