The City Planner has completed a review of your application for Consistency Determination, (APN: 205-
112-3700) which is a modification to CUP 04-12, a request for the installation of seven fabric shade
structures at the Learning Center Library.
After careful consideration of the request, the City Planner has determined that the request meets all of
the findings below and APPROVES this request. The proposed modifications include:
• The installation of seven fabric shade structures with tube steel frames. Five of the seven
structures will be located over the existing second story balconies and two (already installed)
are located over the existing outdoor area. All structures are/will be located on the east side
of the Learning Center Library, as depicted on the site plan. The seven fabric shade structures
have the following dimensions:
• Area 1 -15' 6" x 15' 6"
• Area 2 -15' 6" x 12' 6"
• Area 3 -12' x 9'
• Area 4 -12' x 9'
• Area 5 -17' 6" x 9' O"
• Area 6 -19' 9" x 12' 6"
• Area 7 -36' 2" x 24'
In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings ' must be made:
1) No project condition, feature, facility or amenity is changed or deleted that had been considered
essential to the project's design, quality, safety or function in that the project does not propose
removing any existing architectural elements and the site plan substantially conforms to the
original approval.
2} The request represents an upgrade in overall design features and or materials and improves upon
the project's compatibility with the surrounding neighborhood in that the fabric shade structures
will enhance the existing balconies and outdoor area by adding architectural detail to the
existing east-facing balconies and outdoor area.

3} The proposed revision does not change the density or boundary_ of the subject property in that no
units are proposed to be added or eliminated and the lot size has not changed; therefore, the
density remains the same. '· · ·
4) The proposed revision does not involve the addition of a new land use not shown on the original
permit in that the uses at the Learning Center Library will not change. The Improvements merely
enhance the eastern-facing balconies and outdoor area.
5) The proposed revision does not rearrange the major land uses within the development in that no
land uses will be rearranged.
6) The proposed revision does not create changes of greater than ten percent provided that
compliance will be maintained with the applicable development standards of the Carlsbad
Municipal Code in that the shade structures will not create changes to the building footprint or
to the existing outdoor area.
7) The proposed change will not result in any significant environmental impact, and/or require
additional mitigation in that the shade structures, proposed over existing hardscaped areas, will
not create a significant environmental impact and will improve the site's appearance.
8) The proposed change would not result in any health, safety or welfare impacts In that the shade
structures will meet all structural and building code requirements.
9) There were not any major issues or controversies associated with the original project which would
be exacerbated with the proposed change in that there were no major issues or controversies
associated with the original.approval {CUP 04-12).
10) The proposed change would not be readily discernable to the decision makers as being
substantially different from the project as originally approved in that adding shade structures to
the existing balconies and outdoor area would not be substantially different from the original
project. The existing two shade structures, located over the outdoor area, are not visible from
Eureka Place and therefore would not result In a readily discernable change. The shade
structures proposed over the balconies would not be seen from Eureka Place except for a small
corner of the structures proposed on the south and north sides of the balconies.
Therefore, the City Planner has determined that the application qualifies for a con~istency determination
with the approved permit and approves the changes to the project based on Planning Division
Administrative Policy No. 35.
Please submit two (2) blueline copies (24" X 36") of all applicable exhibits for the project file of the
amended site plan. The copies must be submitted, stamped "Consistency Determination," and signed by
the City Planner prior to issuance of any grading or building permits for the project. The Consistency
Determination Title Block stamp, and other Title Block stamps, can be downloaded from the City's website
at http:/Jwww.carlsbadca.gov/servkes/depts/planning/applications.asp. The Title Block (stamp) is
located at the bottom of the page.
