The City Planner has completed a review of your application for a Consistency Determination, CD 2019-
0018, which is a request for the following changes to Quarry Creek Planning Area R-4B (Cypress), MP 10-
0l(B)/CT 16-05/PUD 16-06, a 56-unit, detached, single-family project:
1. Change_ the design of seven (7) single-family units located on Lots 18-24 from two-story,
detached single-family homes with no roof deck to three-story, detached single-family homes
with roof decks. This change negates what was approved pursuant to CD 2018-0021 for Lots
18-24 and reverts back to the original project approval pursuant to MP 10-01B/CT 16-05/PUD
16-06.
After careful consideration of the request, the City Planner has determined that the request meets all of
the findings below and APPROVES this request.
In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings
must be made:
1) No project condition, feature, facility or amenity is changed or deleted that had been considered
essential to the project's design, quality, safety or function in that the project remains consistent
with the lot size, setbacks and height requirements pursuant to the Quarry Creek Master Plan
and maintains the same mixture of architectural styles. Further, the homes located on Lots 1-
17 will remain two-story as it is a requirement of the Quarry Creek Master Plan, MP 1.0-01(8).
2) The request represents an upgrade in overall design features and or materials and improves upon
the project's compatibility with the surrounding neighborhood in th.at the architectural themes
and materials remain the same. Moreover, the proposed three-story homes with roof decks
were part of the project's original approval and were determined to be compatible with the
Quarry Creek Master Plan.
3) The proposed revision does not change the density or boundary of the subject property in that no
units are proposed to be added or eliminated.
4) The proposed revision does not involve the addition of a new land use not shown on the original
permit in that two-and three-story detached homes are permitted in Planning Area R-48 of the
Quarry Creek Master Plan.

5) The proposed revision does not rearrange the major irNl'uli!s within the development in that two-
and three-story detached homes are permitted /cir 'J:ilcirining Area R-48 in the Quarry Creek
Master Plan and there is not a minimurf{nurnber o/two-or three-story units.
6) The proposed revision does not create changes of greater than ten percent provided that
compliance will be maintained with the applicable development standards of the Carlsbad
Municipal Code in that no additional units are proposed, and the lot size, setbacks and height
will remain the same.
7) The proposed change will not result in any significant environmental impact, and/or require
additional mitigation in that proposed three-story homes with roof decks were part of the
project's original approval and, therefore, any Impacts were previously addressed.
8} The proposed change would not result in any health, safety or welfare impacts.
9) There were not any major issues or controversies associated with the original project which would
be exacerbated with the proposed change.
10) The proposed change would not be readily discernable to the decision makers as being
substantially different from the project as originally approved in that the proposed change reverts
back to what was originally approved pursuant to MP 10-018/CT 16-05/PUD 16-06.
After careful consideration of the circumstances surrounding this request, the City Planner has
determined that the application qualifies for a consistency determination with the approved permit and
therefore, approves the changes to the project based on Planning Division Administrative Policy No. 35.
