The City Planner has completed a review of your application for Consistency Determination CD 2020-0006,
which is a modification to Minor Conditional Use Permit MCUP 13-03, a wireless communication facility
(WCF) located on the roof and behind existing parapets of The Island at Carlsbad commercial center
located at 5814 Van Allen Way, to upgrade the existing WCF. MCUP 13-03 was approved on March 4,
2013, with an expiration date of March 3, 2023; with this modification to the WCF, the expiration date is
hereby extended to March 3, 2030.
After careful consideration of the request, the City Planner has determined that the request meets all of
the findings below and APPROVES this request. The proposed modifications include:
• Addition of three new six-foot-high antennas behind existing screens/parapets
• Addition of three new radios behind existing screens/parapets
• Addition of three new mounting frames behind existing screens/parapets
For a Discretionary Permit Consistency Determination ta be approved, all of the fol/awing findings must be
made:
1) No project canditian, feature, facility or amenity is changed or deleted that had been considered
essential ta the project's design, quality, safety or function in that the proposed modification will
not change the height or location of the existing screens/parapets.
2) The request represents an upgrade in avero/1 design features and ar materials and improves upon
the project's compatibility with the surrounding neighborhood. No changes are proposed to the
existing design features or materials of the building.
3) The proposed revision does not change the density or boundary of the subject property function in
that all aspects of the property remain as previously approved.
4) The proposed revision does not involve the addition of a new land use not shown on the original
permit in that no new land uses are proposed.
5) The proposed revision does not rearrange the major land uses within the development in that all
uses of the property remain as previously approved.

6} The proposed revision does nol3te 11;:'lt greater than ten percent provided that
compliance will be maintained · ;.J;1Jlico'l development standards of the Carlsbad
Municipal Code in that the net addition of three {3} panel antennas behind existing screens
remains consistent with City Council Policy No. 84. There will be no apparent visual changes to
the site and the existing parapet height will not change. Furthermore, the proposed
modifications to the existing WCF qualify as an eligible facility modification pursuant to Section
6409{a) of the Middle-Class Tax Relief and Job Creation Act of 2012 (47 U.S.C. § 1455 (a)).
7) The proposed change will not result in any significant environmental impact, and/or require
additional mitigation in that the proposed project is in substantial conformance with MCUP 13-
03, which determined that the project is categorically exempt from the requirement for the
preparation of environmental documents pursuant to Section 15301 -Existing Facilities of the
CEQA Guidelines.
BJ The proposed change would not result in any health, safety or we/fore impacts in that the
applicant submitted a Radio Frequency Electromagnetic Fields Exposure Report which concludes
that the proposed modification complies with FCC rules and regulations.
9} There were not any major issues or controversies associated with the original project which would
be exacerbated with the proposed change.
10} The proposed change would not be readily discernab/e to the decision makers as being
substantially different from the project as originally approved in that the proposed modification
does not change the use of the site or existing structures.
Therefore, the City Planner has determined that the application qualifies for a consistency determination
with the approved permit and approves the changes to the project based on Planning Division
Administrative Policy No. 35.
