SUBJECT: CUP 09-04 (DEV99042}-SQUIRES DAM COMMUNICATION SITE -1st EXTENSION
The Planning Division has completed a review of your application for the first extension to Conditional
Use Permit CUP 09-04 -SQUIRES DAM COMMUNICATION SITE, located on an existing 150-foot-tall
lattice tower north of Squires Dam. The application was submitted on June 19, 2019, prior to the
expiration date (March 2, 2020}. The project consists of an existing wireless communication facility
(WCF} approved on March 3, 2010, Planning Commission Resolution No. 6572.
After careful consideration of the circumstances surrounding this request, it has been determined that (1)
the project is still in compliance with the Conditional Use Permit regulations in Carlsbad Municipal Code
(CMC) Chapter 21.42 and Wireless Communication Policy 64, and (2) the findings required for granting a
Minor Conditional Use Permit extension can be made; therefore, the City Planner APPROVES the first
extension to Conditional Use Permit CUP 09-04 -SQUIRES DAM COMMUNICATION SITE for ten (10}
years from March 3, 2020, to March 3, 2030, based on the following findings and conditions.
Findings:
1. The permit or approval remains consistent with the general plan, all titles of the code and growth
management program policies and standards in place are the time the extension was considered,
and the findings contained in the Planning Commission resolution dated March 3, 2010, for CUP
09-04 -SQUIRES DAM COMMUNICATION SITE apply to this extension and are incorporated
herein by reference and remain in effect.
2. Circumstances have not substantially changed since the approval was originally granted as the
wireless communication facility is existing and no changes have been proposed with this
extension.
3. The City Planner has determined that the project belongs to a class of projects that the State
Secretary for Resources has found do not have a significant impact on the environment, and it is
therefore categorically exempt from the requirement for the preparation of environmental
documents pursuant to Section 15301-Existing Facilities of the state CEQA Guidelines. In making
this determination, the City Planner has found that the exceptions listed in Section 15300.2 of the
state CEQA Guidelines do not apply to this project.

1. This Conditional Use Permit extension is granted for a period of ten (10) years from March 3,
2020, to March 3, 2030.
2. The conditions contained in Planning Commission Resolution No. 6572 dated March 3, 2010, for
CUP 09-04 apply to this extension and are incorporated herein by reference and remain in effect
except for Planning Condition No. 7, which is superseded by Condition No. 1 of this approval
letter.
