SUBJECT: FIRST EXTENSION FOR CUP 15-09 (DEV12004)-GUNTHER GUNS SHOOTING RANGE
The Planning Division has completed its review of your application for the first extension of Conditional
Use Permit CUP 15-09-GUNTHER GUNS SHOOTING RANGE, submitted on July 25, 2018. The Conditional
Use Permit, which allows for a 16-lane indoor shooting range and 1,680 square foot retail gun store in
an existing 13,932 square foot stand-alone building at 2717 Loker Avenue West and within the Carlsbad
Airport Business Center Specific Plan, was approved on September 27, 2016, and is due to expire on
September 27, 2018.
After careful consideration of the circumstances surrounding this request, it has been determined that (1)
the first extension of Conditional Use Permit CUP 15-09 -GUNTHER GUNS SHOOTING RANGE was
submitted in a timely manner prior to the expiration date, and (2) that the findings required for granting
a Conditional Use Permit extension can be made; therefore, the City Planner APPROVES the first
extension of Conditional Use Permit CUP 15-09-GUNTHER GUNS SHOOTING RANGE for two years from
September 27, 2018, to September 27, 2020, based on the following findings and conditions.
Findings:
1. All the findings contained in City Council Resolution No. 2016-201 dated September 27, 2016, for
,CUP 15-09, and referenced in Planning Commission Resolution No. 7190 dated August 17, 2016,
apply to this extension and are incorporated herein by reference and remain in effect.
2. That the first two-year extension from September 27, 2018, to September 27, 2020, is appropriate
because the owner/applicant is diligently pursuing finalizing all necessary permits, the project is still
consistent with the Conditional Use Permit regulations, and the extension would allow the
owner/applicant to preserve existing property entitlements while satisfying the conditions for a 16-
lane indoor shooting range and 1,680 square foot retail gun store within an existing 13,932 square
foot stand-alone building (CUP 15-09}.
3. That such permits and approvals as extended are consistent with the requirements of Title 21 of this
code at the time of their extension.
4. That the City Planner has determined that the project belongs to a class of projects that the State
Secretary for Resources has found do not have a significant impact on the environment, and it is
therefore categorically exempt from the requirement for the preparation of environmental

documents pursuant to Infill Development Projects -Section 15332 of the state CEQA Guidelines. In
making this determination, the City Planner has found that the exceptions listed in Section 15300.2 of
the state CEQA Guidelines do not apply to this project.
Conditions:
1. This first extension of the Conditional Use Permit is granted from September 27, 2018, to September
27, 2020. If building permits for this project or an occupancy permit is not obtained within this time
period, the Conditional Use Permit will expire on September 27, 2020, unless extended per Sections
21.58.040 of the Carlsbad Municipal Code.
2. All of the conditions contained in Planning Commission Resolution No. 7190 dated August 17, 2016,
for CUP 15-09 apply to this extension and are incorporated herein by reference and remain in effect
except for Condition No. 7, which is replaced by Condition No. 1 above; and Condition No. 9, which
has already been completed.
