The Planning Division has completed a review of your application for a Conditional Use Permit Extension,
CUP 260{E)xl -PALOMAR TRANSFER STATION, located at 5960 El Camino Real on 10.98 acres of land.
The project was approved by the City Council on March 10, 2015.
The adopted project conditions for CUP 260(E), which are contained in Planning Commission Resolution
No. 7080, still apply to this project (CUP 260[E]x1). Therefore, if building permits are not pulled by
November 6, 2016 the CUP will expire. The applicant has requested a two year time extension to pull
building permits.
After careful consideration of the circumstances surrounding this request, it has been determined that (1)
the project is still in compliance with the Conditional Use Permit regulations Carlsbad Municipal Code
(CMC) Chapter 21.42, and (2) that the findings required for granting a Conditional Use Permit extension
can be made; therefore, the City Planner APPROVES Conditional Use Permit Extension No. CUP 260l&j,(1"<P)
for two (2) years from November 6, 2016 to November 6, 2018, based on the following findings and
conditions.
Findings:
1. All of the findings contained in the Planning Commission Resolution No. 7080 dated January 21, 2015
and City Council Resolution No. 2015-063 dated March 10, 2015 for CUP 260{E) apply to this
extension and are incorporated herein by reference and remain in effect.
2. That the two {2)-year extension (from November 6, 2016 to November 6, 2018) is appropriate
because the owner/applicant is diligently pursuing finalizing all necessary permits, the project is still
consistent with the Conditional Use Permit regulations, and the extension would allow the
owner/applicant to preserve existing property entitlements.
3. That such permits and approvals as extended are consistent with the requirements of Title 21 of this
code at the time of their extension.
4. The project (CUP 260[E]) was previously evaluated in the FEIR (04-03), dated September 2004, and
adopted by the City Council at its February 1, 2005 meeting. The FEIR evaluated the potential

circulation system, to allow public access to the PTS Monday through Friday 7:00 a.m. to 4:00 p.m.
and 7:30 a.m. to 4:00 p.m. on Saturday and Sunday. The proposed project is within the scope of the
prior environmental document and no further environmental documentation is required per
California Environmental Quality Act (CEQA) Guideline Section 15162.
The project (CUP 260[0]) is exempt from the California Environmental Quality Act (CEQA) per CEQA
Guidelines Section 15303 -new construction of small structures. A Notice of Exemption was filed
with the San Diego County Clerk on November 9, 2012.
Conditions:
1. This Conditional Use Permit extension is granted from November 6, 2016 to November 6, 2018. If
building permits for this project are not obtained within this time period, the Conditional Use Permit
extension will expire on November 6, 2016, unless extended per Section 21.201.210 of the Carlsbad
Municipal Code.
2. Alt of the conditions contained in Planning Commission Resolution No. 7080 dated January 21, 2015
and City Council Resolution No. 2015~063 dated March 10, 2015 for CUP 260(E) apply to this
extension and are incorporated herein by reference and remain in effect except for the time
extension stated In Planning Condition No. Z in Planning Commission Resolution No. 7080 which is
superseded by Condition No. 1 of this approval letter.
