Thank you for submitting an Early Assessment to construct a permanent restroom facility to replace the
existing temporary restroom at Cannon Park. The restroom will have two ADA accessible bathrooms and
one non-ADA accessible bathroom. The structure would be 22 feet 8 inches long by 12 feet 8 inches wide
and approximately 13 feet tall with approximately 50 square feet of additional concrete impervious paving
material to accommodate the new ADA path of travel from the existing sidewalk into the ADA accessible
stalls.
In response to your application, the Planning Division has prepared this comment letter. Please note that
the purpose of an Early Assessment is to provide you with direction and comments on the overall concept
of your project. This Early Assessment does not represent an in-depth analysis of your project. It is
intended to give you feedback on critical issues based upon the information provided in your submittal.
This review is based upon the plans, policies, and standards in effect as of the date of this review. Please
be aware that at the time of a formal application submittal, new plans, policies, and standards may be
in effect and additional issues of concern may be raised through a more specific and detailed review.
Planning:
General
1. The Cannon Park site is zoned Open Space (OS}, which allows public restrooms as accessory to a
primary permissible use, i.e., a public park. In the OS zone, a public park is permissible subject to
issuance of a conditional use permit (CUP} by the Planning Commission, in accordance with the
findings, conditions, and development standards and special regulations contained in Carlsbad
Municipal Code (CMC} Chapter 21.42. Planning Division staff could find no record of a CUP having
been issued for Cannon Park. Therefore, please submit a CUP application to the Planning Division
for Planning Commission consideration of all existing and contemplated park-related uses on the
site, including the proposed restroom facilities.
Please note the special standards and regulations in CMC 24.42.140(8}(100} relating to public
parks, including the need to include a master park site plan exhibit (see attachment}. The master
park site plan exhibit shall inclu9e the general location of and maximum anticipated site area and
building area of existing and proposed major and accessory park uses.

2. The project is located in.the Agua Hedionda Lagoon Segment of the Local Coastal Program (area
of deferred certification) and may require a CDP issued by the California Coastal Commission (CCC)
once local permits have been obtained. Please contact the San Diego Coast District Office of the
CCC at (619) 767-2370 to discuss whether a Coastal Development Permit (CDP) issued by the CCC
will be needed.
3. The proposed restroom facility may be found exempt from the California Environmental Quality
Act (CEQA) per State CEQA Guidelines Section 15303(d) & (e) -concerning new construction of
small structures such as restroom facilities and utility extensions.
Land Development Engineering:
4. Regarding temporary construction BMP/SWPPP requirements, concurrent the project design,
applicant shall complete a Determination of Project's SWPPP Tier Level and Construction Threat
Level Form pursuant to City Engineering Standards. Developer shall also submit the appropriate
Tier level Storm Water Compliance form and appropriate Tier level Storm Water Pollution
Prevention Plan (SWPPP) to the satisfaction of the city engineer.
5. Regarding permanent post-construction BMP requirements, concurrent the project design,
applicant must complete the City's Stormwater Standards Questionnaire (E-34 form) .. Based on
the outcome of the E-34, the project will either be subject to Standard Storm Water requirements
or Priority Development Project (PDP) requirements. If determined to be subject to Standard
Stormwater requirements, Applicant shall complete the City's E-36 form and incorporate
applicable Standard Stormwater requirements into the project design. If determined to be a PDP,
concurrent with design, Applicant shall prepare a Storm Water Quality Management Plan prior to
approval of the project and incorporate all Standard Stormwater requirements together with
Treatment Control (post-construction) BMPs and applicable hydromodification BMPs into the
project design all in accordance with the City BMP Design Manual, latest version.
