Thank you for submitting a preliminary review for the construction of a driveway at Car Country Drive
opposite 5365 Car Country Drive. The driveway proposes to provide access to the parcel currently used
as agricultural land. The applicant has stated to Planning staff that the proposed driveway will be built in
order to use the area, currently used as agricultural land, as an overflow parking area for visitors and
employees to the adjacent flower fields in Planning Area 7 during peak tourism season, as well as access
for farming equipment and personnel. The applicant estimates that the area will continue to be used as
agricultural land for part of the year and will be seasonally converted to a parking area to fit 40-50 cars.
In response to your application, the Planning Division has prepared this comment letter. Please note that
the purpose of a preliminary review is to provide you with direction and comments on the overall concept
of your project. This preliminary review does not represent an in-depth analysis of your project. It is
intended to give you feedback on critical issues based upon the information provided in your submittal.
This review is based upon the plans. policies, and standards in effect as of the date of this review. Please
be aware that at the time of a formal application submittal, new plans. policies. and standards may be
in effect and additional issues of concern may be raised through a more specific and detailed review.
Planning:
General
1. General Plan and zoning designations for the property are as follows:
a. General Plan: OS, Open Space
b. Zoning: CR-A/OS, Cannon Road Agricultural Open Space
c. Coastal Zone land use designation: OS, Open Space
d. Specific Plan: Carlsbad Ranch Specific Plan (Planning Area 8}
e. Airport Influence Area: Review Area 2
2. The project requires the following permits:
a. Coastal Development Permit (CDP)
b. Site Development Plan (SDP)
c. Minor Conditional Use Permit (MCUP)
d. Landscape Plan Check
e. Grading Permit

Because both the CDP and the SDP require action by the Planning Commission, the MCUP will be
processed concurrently for consideration by the Commission per CMC Section 21.54.040 (C). The
MCUP will be taken in as a Major CUP for processing purposes, but a Minor CUP fee will be charged.
3. Per Carlsbad Municipal Code (CMC) Section 21.209.080, Development and Design Guidelines for the
CR-A/OS zone, the project requires a Site Development Plan and is subject to the following
subsections:
a. G (Public Art)
b. H (Public Access)
c. J (Civic and Public Gathering Places)
d. L (Traffic and Circulation)
In addition, the project will be subject to CMC Section 21.209.070, Pre-submittal Community Input
Process.
4. Based on the submitted information, staff will not be able to support the proposed driveway for
access to seasonal parking in Planning area 7 in the absence of a proposal for the development of a
specific use for the property. The proposed seasonal parking area to be served by the driveway is
considered a secondary or accessory use which requires a primary use within the property and
Planning Area 8.
5. The parking area served by the proposed driveway is subject to Table B in CMC Section 21.44.050.
Submission of plans accurately detailing the parking area will be required.
6. The recordation of a private agreement will be required to allow reciprocal vehicular access and
parking between the properties in Planning Areas 7 and 8.
7. A conceptual landscape plan shall be submitted with the project application in compliance with the
City's Landscape Manual. The Landscape Manual is available for review on the City of Carlsbad
website at:

8. Per City Council Policy #84, Development Project Public Involvement Policy, all development
applications that require Planning Commission or City Council approval shall provide early public
notification. Legal noticing requirements, which are in addition to the applicants' early public

9. Please be advised that in order to provide a thorough review of the proposed development, a more
complete design of the project is required. This preliminary review does not constitute a complete
review of the proposed project and additional items of concern may be identified upon formal project
application submittal. Please refer to the Development Permits P-2 checklist for all of the necessary
required items prior to formal submittal.

All necessary application forms, submittal requirements, and fee information are available at the Planning
counter located in the Faraday Building at 1635 Faraday Avenue or online at
http://www.carlsbadca.gov/services/depts/planning/default.asp. You may also access the General Plan
Land Use Element and the Zoning Ordinance online at the website address shown; select Department
Listing; select Planning Home Page. Please review all information carefully before submitting.
Land Development Engineering:
Land Development Engineering Division staff has completed a preliminary review of the above-referenced
project. Prior to formal application submittal the following items must be adequately resolved/addressed:
10. Staff is not supportive of adding a driveway entrance on Car Country Drive to provide access for farm
equipment or any other use when an access on Cannon Road already provides adequate access.
Please clarify the purpose for establishing this driveway access. Will it be used for car storage,
overflow parking, the general public, agricultural maintenance, etc. or a combination of uses? Provide
a full description and plan for all proposed uses, including any seasonal uses.
11. Complete a Stormwater Standards Questionnaire. This questionnaire will guide you and the City in
determining what type of reports and storm water mitigation must be completed to satisfy state and
City storm water quality requirements. The questionnaire can be printed from the following website

12. Since less than 5,000 square feet of impervious area is apparently proposed, preliminary analysis
suggests that the project is a Standard Project and subject to installing site design and source control
BMPs per Chapter 4 of the Carlsbad BMP Design Manual and per the Standard Project Requirement
Checklist (E36) that will also need to be completed. The link to the form is at:

13. Even if the project is not defined as a Priority Development Project, the driveway will still need site
design treatment by directing drainage over pervious area or using pervious pavement. Consider
adding a trench drain at the end that leads to a water treatment quality basin or vegetated swale
before draining to the street. Any pavement design, pervious or impervious, will be subject to soils
engineer recommendations which will need to be submitted with your application for grading permit.
14. A grading permit will be required.
15. Avoid concentrating drainage runoff down the slope via the earth berms identified under note 3.
16. Plot location of agricultural areas that will receive fill from the project cuts and show proposed fill
distribution. Include in disturbed area calculations.
17. Stability of AB from erosion on an 11% grade is a concern. Please address means of enhancing stability
without rendering surface impervious or provide alternative surface.
18. The existing trench appearing in the driveway profile that will be removed with the grading appears

to be directing drainage from the slope above laterally where the driveway is proposed. Please
determine if this is the case and address accordingly.
19. Gravel shall not be used as a means for widening the driveway as currently proposed. Reduce the
driveway width and curb cut to 24 feet of paved surface. The gravel may be installed to continue the
driveway at the top of slope where the grade levels.
20. Would gates be proposed to limit or prevent public access? If so, show location and type of gate
proposed.
