Thank you for submitting a preliminary review for a tenant improvement project proposed at 5444 Paseo
del Norte. The project site, an approximately 4.47-acre lot, currently is developed with a car dealership.
In response to your application, the Planning Division has prepared this comment letter. Please note that
the purpose of a preliminary review is to provide you with direction and comments on the overall concept
of your project. This preliminary review does not represent an in-depth analysis of your project. It is
intended to give you feedback on critical issues based upon the information provided in your submittal.
This review is based upon the plans, policies, and standards in effect as of the date of this review. Please
be aware that at the time of a formal application submittal, new plans, policies, and standards may be
in effect and additional issues of concern may be raised through a more specific and detailed review.
Planning:
General
1. General Plan and zoning designations for the property are as follows:
a. General Plan: Regional Commercial (R)
b. Zoning: C-2
c. The property is in the Coastal Zone. The coastal land use designation and zone are the same
as the general plan and zoning above.
d. Specific Plan: Car Country Carlsbad Specific Plan 19 (SP 19)
2. The project requires the following permits:
a. Coastal Development Permit
b. Landscaping Plan Check
c. Building Permit
d. Sign Permit
3. As described in the scope of work, this preliminary review application is for the remodel of the
fa~ade of two existing buildings and the addition of a customer lounge and car delivery canopy.

The Carlsbad Municipal Code (CMC) and SP 19 permits and encourages the operation of car
dealerships on the property. As shown on the submitted plans and other documents, the addition
of new floor area and canopy would exceed the maximum allowed lot coverage. Staff supports
the proposed project with minor revisions to meet the maximum lot coverage requirements. The
Planning Commission is the final decision-making body for the Coastal Development Permit.
4. A Site Development Plan will be required only if the area of the addition exceeds 10 percent of
the existing square footage for the buildings (first and second stories combined).
5. The project is subject to all applicable CMC and SP 19 standards. Specifically, staff has concerns
with the foUowing:
a. SP 19 allows a maximum of 25 percent of lot coverage on the property (Part 2, Section II (B)).
As shown on the plans and based on the 4.47-acre lot area, the project exceeds the allowed
lot coverage. Please see building coverage definition in CMC Section 21.04.061.
b. Building and canopy setback dimensions shall be shown on plans per SP 19 Part 2, Section II
(E) for properties located east of Paseo del Norte.
c. A parking plan and analysis shall be provided based on the modified building uses per SP 19
Part 2, Section II (F).
d. Proposed landscaping is subject to SP 19 Part 2, Section IV and the City of Carlsbad Landscape
Manual.
e. All proposed signs are subject to Part 4 of SP 19 and CMC Chapter 21.41. A separate sign
permit and review will be required.
f. Pursuant to CMC 21.41.080(C)(l), the logo sign on the blade wall shall be located below the
edge of the existing building roof line (service canopy) or adjacent parapet height.
6. Per SP 19 Part, Section I (A) and Section II (D), buildings shall incorporate design elements
consistent with Spanish/Mediterranean architectural styles.
a. The proposed modifications to the service lounge fa~ade take the building further towards a
modern style rather than Spanish/Mediterranean. The removal of the tile, increase in height
and addition of the angled, projecting blade wall are generally inconsistent with
Spanish/Mediterranean architecture. The new canopy also has a very modern appearance.
Please study ways to achieve a desired aesthetic that uses elements consistent with the
Spanish/Mediterranean architectural vocabulary. Refer to SP 19 Part 2, Section II (D) for more
guidance.
b. Use dark brown aluminum mullions on doors and windows instead of silver.
c. Use smooth-finish stucco for the proposed fa~ade and fascia work.
7. New forthcoming requirements related to the city's Climate Action Plan (CAP) will likely impact
development requirements of this project. A formal application submittal will need to include a
completed CAP Checklist (Form P-30) to determine what requirements will apply to the project.
New CAP requirements are related to energy efficiency, photovoltaic, electric vehicle charging,
water heating and traffic demand management requirements, as set forth in City Council
Ordinance Nos. CS-347, CS-348, CS-349 and CS-350 and City Council Resolution No. 2019-024
which are available on the city's website at the following address:

To the extent that some or all of the new CAP requirements are in effect at the time of application
for grading or building permits, the project will be required to comply with the effective
requirements even if different than what is proposed in the project's planning approvals. CAP
requirements may impact, but are not limited to, site design and local building code requirements.
Once adopted as part of Title 18 and in effect, plans submitted for grading or building permits
must demonstrate compliance with the new CAP requirements. If incorporating new CAP
requirements results in substantial modifications to the project after planning approvals are
obtained, then prior to issuance of grading or building permits, the applicant may be required to
submit and receive approval of a Consistency Determination or an Amendment application for
the project through the Planning Division.
8. A conceptual landscape plan will be required with the Coastal Development Permit if proposing
to modify 2,500 square feet or more of the existing landscaped areas. Please note that the
Conceptual Landscape Plans shall be prepared in accordance with the General Requirements
listed in Section 3 of the City of Carlsbad Landscape Manual (February 2016). The City of
Carlsbad's Landscape Manual document can be found on the Planning Division's web page at the

All necessary application forms, submittal requirements, and fee information are available at the
Planning counter located in the Faraday Building at 1635 Faraday Avenue or online at

General Plan Land Use Element and the Zoning Ordinance online at the website address shown;
select Department Listing; select Planning Home Page. Please review all information carefully
before submitting.
Land Development Engineering:
1. Complete the city's Storm Water Standards Questionnaire (Form E-34). This questionnaire will
guide you and the City in determining what type of reports and storm water mitigation must be
completed to satisfy state and City storm water quality requirements. The questionnaire can be
obtained on the city's web site. Preliminary analysis suggests that the project is a 'Standard'
Project and shall provide two completed Standard Project Requirement Checklist (E-36 ~arm).
The form is available on the city's website.
2. A preliminary title report dated within 6 months of the application date is required with the
submittal of a discretionary application and final engineering application. Show and label on the
plans, all easements listed in said report.
3. Show and label on the site plan, the adjacent structures/buildings and contours within 25-ft of
the project boundary.
4. Show and label on the site plan, any utilities and appurtenances in the project vicinity. If existing
facilities, utilities and appurtenances are to be impacted due to the proposed work, clarify on the
plans whether those facilities, utilities, and appurtenances are to remain, to be relocated, or to
be removed.
5. Address the redline comments on the plans.
