SUBJECT: PRE 2020-0010 (DEV2020-0107) -SHELL LIGHT-DUTY HYDROGEN STATION

Thank you for submitting a preliminary review for the addition of two new hydrogen dispensing pumps,
above ground equipment and an equipment enclosure to an existing developed site proposed at 7170
Avenida Encinas. The project site, an approximately 49,658-square-foot (1.14 acres) lot, currently is
developed with a gas station and drive-thru car wash.
In response to your application, the Planning Division has prepared this comment letter. Please note that
the purpose of a preliminary review is to provide you with direction and comments on the overall concept
of your project. This preliminary review does not represent an in-depth analysis of your project. It is
intended to give you feedback on critical issues based upon the information provided in your submittal.
This review is based upon the plans, policies, and standards in effect as of the date of this review. Please
be aware that at the time of a formal application submittal, new plans, policies, and standards may be
in effect and additional issues of concern may be raised through a more specific and detailed review.
Planning:
General
1. General Plan and zoning designations for the property are as follows:
a. General Plan: Local Shopping Center (L)
b. Zoning: Local Shopping Center Zone (C-L)
c. Within the Appealable area of the Coastal Zone
d. Within the Commercial/Visitor Serving Overlay
2. The project requires the following permits issued by the Planning Division:
a. Consistency Determination /CD). An application for a Consistency Determination is required to be
submitted for review to determine if the project is consistent with the original project approval
(CUP 99-15 and CDP 99-35). The application must include a response that demonstrates
compliance with the criteria contained in Policy 35. Policy 35 can be found in the Consistency
Determination application provided here:

3. Gas Station Requirements. Please refer to Carlsbad Municipal Code (CMC) Section 21.42.140 for
applicable development provisions specifically for the renovation of existing gas stations. These
provisions include but are not limited to a minimum six-foot width for landscape planter areas,
exterior lighting and enclosure heights.
4. Development Standards.
a. Building Height. No building within the C-L zone shall exceed 35 feet (ft.) and allowed protrusions
as described in CMC Section 21.46.020 shall not exceed a height of 45 ft.
b. Fences. In accordance with CMC Section 21.31.080, walls and fences up to a height of six feet are
permitted except that no wall or fence shall be erected in excess of 42 inches in height within a
yard adjacent to streets. Chain link, barbed wire, razor ribbon or other similar fences are
specifically prohibited.
c. Yards. All yards except the front yard along the street front is required to have a minimum depth
of 10 ft.
5. Commercial-Visitor Serving Overlay Zone. The project is subject to the Commercial-Visitor Serving
Overlay Zone, CMC Chapter 21.208. The following should be addressed in a formal submittal:
a. Setbacks. Buildings and other structures shall maintain a minimum setback of 30 ft. from the
public street.
b. Screening of Areas for Loading/Delivery/Enclosures. Enclosure areas shall be located onsite so as
to be screened from public points of view. Landscaping may assist this objective but is secondary
to locating enclosures onsite and/or using solid masonry walls to minimize visibility. See comment
8 below regarding the design of the enclosure.
6. Site Plan: The site plan must accurately show all existing buildings, setbacks, hardscape, and landscape .
areas. The site plan shall be fully dimensioned and shall also include all existing and proposed walls
and fences with heights from the lowest adjacent grade. Please ensure the proposed equipment
enclosure is outside of the required 30 ft. setback area along the street frontage.
7. Elevation Plans. Additional information such as elevations showing the height dimensions of the
proposed equipment is required to be included with a formal application. All equipment should be
fully screened by a masonry wall and landscaping.
8. Design and Materials. The proposed equipment enclosure should be constructed with a masonry wall
that is designed and finished in colors and materials that match the existing retail and car wash
building onsite.

9. Landscaping. Landscaping such as trees, shrubs, and vines should be installed around the equipment
enclosure for screening of equipment. A conceptual landscape plan is required with the formal
submittal. In addition, if the removal and rehabilitation of landscaping is less than 2,500 sq. ft., it will
not require a subsequent landscape plan check application but will require compliance with the City's
Landscape Manual. Removal or rehabilitation of landscaping that exceeds 2,500 sq. ft. in area will
require submittal of a formal landscape plan check application to the Planning Division after approval
of the amendment and prior to issuance of building permits. The Landscape Manual is available for

All necessary application forms, submittal requirements, and fee information are available at the Planning
counter located in the Faraday Building at 1635 Fara<Jay Avenue or online at
http://www.carlsbadca.gov/services/depts/planning/default.asp. You may also access the General Plan
Land Use Element and the Zoning Ordinance online at the website address shown; select Department
Listing; select Planning Home Page. Please review all information carefully before submitting.
Land Development Engineering:
1. Complete the city's Storm Water Standards Questionnaire (Form E-34). This questionnaire will guide
you and the City in determining what type of reports and storm water mitigation must be completed
to satisfy state and City storm water quality requirements. The questionnaire can be obtained on
the city's web site. Based on city records, it appears this site has existing permanent water quality
BMPs and is subject to maintain Priority Development Project requirements. The project will be
required to demonstrate that any additional impervious area created will be adequately addressed
with the existing permanent water quality BMPs or through any necessary modifications to existing
BMPs.
2. A preliminary title report dated within 6 months of the application date is required with the
submittal of a discretionary application and final engineering application. Show and label on the
plans, all easements listed in said report.
3. Show and label on the site plan, the APNs and/or short legal description of all adjacent properties.
4. Show and label on the site plan, any existing utilities such as water, sewer, and storm drain and
appurtenances in the project vicinity. If existing facilities, utilities and appurtenances are to be
impacted due to the proposed work, clarify on the plans whether those facilities, utilities, and
appurtenances are to remain;to be relocated, or to be removed.
5. Show and label on the site plan, the existing and proposed grades or contours.
6. Address the red line comments on the plans at the time of formal submittal.

Building:
1. The operable parts, clear floor space, and reach ranges are subject to CBC llB-309.
2. Electrical wiring/classification is subject to NEC Article 500/NFPA 70.
3. The project shall comply with state accessibility requirements and the city's Climate Action Plan (CAP).
1. All construction submittal drawings shall be submitted to the Fire Department for review in
