The Planning Division has completed its review of your application for the first extension of Site
Development Plan SOP 2017-0010, Conditional Use Permit CUP 2017-0012, Special Use Permit SUP
2017-0007 (PUB 2017-0033), DESALINATION FLOW CONTROL FACILITY 5, located at 5950 El Camino Real
and within the public rights-of-way on Faraday Avenue, Orion Street and El Camino Real within Local
Facilities Management Zone 5. The project was approved on March 7, 2018 and is due to expire on March
7, 2020.
After careful consideration of the circumstances surrounding this request, it has been determined that (1)
the first extension of Site Development Plan SOP 2017-0010, Conditional Use Permit CUP 2017-0012,
Special Use Permit SUP 2017-0007 -DESALINATION FLOW CONTROL FACILITY 5 was submitted in a
timely manner prior to the expiration date, (2) there has been no change of circumstances in relation to
the regulations (i.e., Title 21 of the Carlsbad Municipal Code), (3) the project is still in compliance with the
regulations and (4) that the findings required for granting a Site Development Plan, Conditional Use
Permit, and Special Use Permit extension can still be made; therefore, the City Planner APPROVES the
first extension of Site Development Plan SOP 2017-0010, Conditional Use Permit CUP 2017-0012, Special
Use Permit SUP 2017-0007-DESALINATION FLOW CONTROL FACILITY 5 for two years from March 7, 2020, to March 7, 2022, based on the following findings and conditions.
Findings:
1.All the findings contained in the Planning Commission Resolution No. 7290 dated March 7, 2018, for
Site Development Plan SOP 2017-0010, Conditional Use Permit CUP 2017-0012, Special Use Permit
SUP 2017-0007, apply to this extension and are incorporated herein by reference and remain in effect.
2.The approval remains consistent with the General Plan, Title 21 and growth management program
policies and standards in place at the time this extension was considered.
3.That circumstances have not substantially changed since Site Development Plan SOP 2017-0010,Conditional Use Permit CUP2017-0010, Special Use Permit SUP 2017-0007 was originally approved.

4. That the first two-year extension {from Marc~;j~Q,;~~;,L;:, 7, 2022) is appropriate because the
owner/applicant is diligently pursuing finalizing all necessary pe'fmits, the project remains consistent
with the Site Development Plan SOP 2017-0010, Conditional Use Permit CUP2017-0010, Special Use
Permit SUP 2017-0007 regulations, and the extension would allow the owner/applicant to preserve
existing property entitlements.
5. All project related permits or approvals, which were granted concurrently, shall be extended to expire
concurrently, provided all such permits are extended pursuant to the provisions of Title 21.
6. This project (Site Development Plan SOP 2017-0010, Conditional Use Permit CUP 2017-0012, Special
Use Permit SUP 2017-0007) was previously evaluated in the 2018 Fifth Addendum to the Final
Environmental Impact Report (FEIR 03-05) for the Carlsbad Desalination Project dated June 13, 2006
(Carlsbad 2006; SCH No. 2004041081). The FEIR evaluated the potential environmental effects of this
project and no further environmental documentation is required per the Environmental Quality Act
{CEQA) Guidelines 15162.
Conditions:
1. This first extension of the Site Development Plan, Conditional Use Permit, and Special Use Permit is
granted from March 7, .2020 to March 7, 2022. If building permits for this project or an occupancy
permit is not obtained within this time period, the Site Development Plan, Conditional Use Permit,
Special Use Permit will expire on March 7, 2022, unless extended per Sections 21.58.040 of the
Carlsbad Municipal Code.
2. All of the conditions contained in Planning Commission Resolution No. 7290 dated March 7, 2018, for
SOP 2017-0010, CUP 2017-0012, SUP 2017-0007 apply to this extension and are incorporated herein
by reference and remain in effect, except condition No. 9 in Planning Commission Resolution No.
7290; which is hereby superseded by Condition No. 1 above.
