The Minor Site Development Plan, which allows for the development of one (1) office building totaling 100,000 square feet (SF), expansion of a previously-approved parking structure, and associated site modifications, was approved on December 26, 2018, with an expiration date of December 26, 2020. After careful consideration of the circumstances surrounding this request, it has been determined that (1) the first extension of Minor Site Development Plan SDP 2018-0008 -VIASAT BRESSI RANCH CAMPUS was submitted in a timely manner prior to the expiration date, and (2) that the findings required for granting a Minor Site Development Plan extension can be made; therefore, the City Planner APPROVES the first extension of Minor Site Development Plan SDP 2018-0008 -VIASAT BRESSI RANCH CAMPUS for two (2) years from December 26, 2020, to December 26, 2022, based on the following findings and conditions. Findings: 1. All the findings contained in City Planner approval letter dated December 26, 2018 for S.DP 2018- 0008 -VIASAT BRESSI RANCH CAMPUS, apply to this extension and are incorporated herein by reference and remain in effect. 2. That the first extension of Minor Site Development Plan SDP 2018-0008 remains consistent with the General Plan, all titles of the Carlsbad Municipal Code and growth management program policies and standards in place at this time. 3. The City Planner has determined that: A. The project is a subsequent activity of the Bressi Ranch Master Plan, MP 178(K), a project for which a program EIR was prepared, and this activity is within the scope of the program approved earlier, and that the program EIR adequately describes the activity for the purposes of CEQA); [15168(c)(2) and (e)]; and B. The Bressi Ranch Master Plan Final EIR 98-04 was certified by the City Council on July 9, 2002 in connection with the prior project or plan; and D. The project is consistent with the Climate Action Plan (CAP} through compliance with the CAP checklist and the incorporation of project design features that reduce GHG emissions; E. The project has no new significant environmental effect not analyzed as significant in the prior EIR; and F. None of the circumstances requiring a Subsequent EIR or a Supplemental EIR under CEQA Guidelines Sections 15162 or 15163 exist; and G. All feasible mitigation measures or project alternatives identified in the EIR 98-04, which are appropriate to this Subsequent Project, have been completed, incorporated into the project design or are required as conditions of approval for this Subsequent Project. Conditions: Note: Unless otherwise specified herein, all conditions shall be satisfied prior to issuance of a grading permit or building permit, whichever occurs first. 1. This first extension of Minor Site Development Plan SDP 2018-0008 is granted from December 26, 2020, to December 26, 2022. If building permits for this project are not obtained within this time period, the Minor Site Development Plan will expire on December 26, 2022, unless extended per Sections 21.58.040 and 21.201.210 of the Carlsbad Municipal Code. 2. All of the conditions contained in City Planner approval letter dated December 26, 2018 for SDP • 2018-0008-VIASAT BRESSI RANCH CAMPUS apply to this first extension and are incorporated herein by reference and remain in effect except for Condition No. 10, which is superseded by Condition No. 1 of this approval letter.
