HomeMy WebLinkAboutV 2019-0001; HARRIS RESIDENCE BOAT VARIANCE; Admin Decision LetterMarch 5, 2020 Edward & Rose Harris 2746 Auburn Avenue Carlsbad, CA 92010 FILE SUBJECT: V 2019-0001 (DEV2019-0065) -HARRIS RESIDENCE BOAT VARIANCE ( City of Carlsbad The City Planner has completed a review of your application for an Administrative Variance, V 2019-0001, to allow the parking of a 7' -3" -wide by 17' -4"-long boat in the required front yard setback located at 2746 Auburn Avenue. After careful consideration of the circumstances surrounding this request, the City Planner has determined that the four findings required for granting an Administrative Variance can be made and therefore, APPROVES this request based on the following findings and conditions. Findings: 1. That parking in, or access to, the side or rear yard will require structural alteration to the existing residence, and will require the removal of significant or unique landscaping in that requiring the boat to be within the side or rear yard (CMC Section 21.44.060 Table E) is not possible as it would require significant structural alterations to the residence, and removal of existing retaining walls and mature palm trees to accommodate the boat in the side or rear yards. Additionally, there is not sufficient depth or area in the front yard between the home and the front yard setback line to accommodate the boat. 2. That parking in, or access to, the side or rear yard will require extensive grading in that the side yards between the property line and the residence are narrow which constrains the boat to the driveway. In addition, a retaining wall on the east side yard of the property, and a swimming pool on the west side yard further restrict boat access and parking. These existing conditions would require extensive earthwork and structural alterations in order to accommodate the boat in the side or rear yard. 3. That parking the recreational vehicle in the front yard will not interfere with visibility to or from Auburn Avenue in that: a. The subject property and the adjacent lots' physical characteristics do not create inherent sight distance issues along the street. b. The subject property's long driveway can adequately accommodate the 17'-4"-long boat without encroaching into the sidewalk and public right-of-way, and thus will not interfere with visibility to or from Auburn Avenue. c. As conditioned, the boat will not interfere with visibility to Auburn Avenue from passenger vehicles exiting from the subject property's driveway. The boat will not interfere with visibility to Auburn Avenue from the driveways of the adjacent properties to the east and west. That the recreational vehicle in the front yard will not interfere with traffic on the street or sidewalk or encroach into the street and utility right-of-way in that the widened driveway of the residence is approximately 24' -7" feet long at its shortest distance from the front property line, which is an adequate depth to park a 17' -4" -foot-long boat. There is an additional five feet to the back of sidewalk; therefore, the boat will allow for street and sidewalk traffic to proceed unobstructed. 5. In the City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15305 -minor alterations in land use limitations. In making this determination, the City Planner has found that the exceptions listed in Section 15300.2 of the state CEQA Guidelines do not apply to this project. 6. The City Planner has reviewed each of the exactions imposed on the Developer contained in this resolution, and hereby finds, in this case, that the exactions are imposed to mitigate impacts caused by or reasonably related to the project, and the extent and the degree of the exaction is in rough proportionality to the impact cau.sed by the project. Conditions: · 1. The boat shall be parked on the widened westerly portion of the driveway at 2746 Auburn Avenue at all times when on-site and shall not obstruct access to the two-car garage. 2. Approval is granted for V 2019-0001 as shown on Exhibit "A", dated January 27, 2020, on file in the Planning Division and incorporated herein by reference. Development shall occur substantially as shown unless otherwise noted in these conditions. This decision may be appealed by you or any member of the public to the Planning Commission within ten days of receipt of this letter. Appeals must be submitted in writing to the Planning Commission at 1635 Faraday Avenue in Carlsbad, along with a payment of $876.00. The filing of such appeal within such time limit shall stay the effective date of the order of the City Planner until such time as a final decision on the appeal is reached.
