The City Planner has completed a review of your application for an Administrative Variance, V 2019-0002,
located at 1815 Bienvenida Circle. After careful consideration of the circumstances surrounding this
request, the City Planner has determined that the findings required for granting an Administrative
Variance to park a boat in the front yard can be made and therefore, APPROVES this request based on
the following findings and conditions.
Findings:
1. That parking in, or access to, the side or rear yard will require structural alteration to the existing
residence in that requiring the boat and trailer to be parked in the side or rear yard (CMC Section
21.44.060 Table E) is not possible as it would require significant structural alterations to the
residence or removal of mature landscaping. The dimensions of the boat and trailer are 6.5 feet
wide by 18 feet long. The side yard setback is 7.5 feet to the westerly property line and 12.5 feet
to the easterly property line. The boat cannot be parked along the westerly side yard as the roof
eave reduces the usable width and access to the yard. The easterly side yard has a fish pond and
mature landscaping between the front setback line and the residence. It is infeasible to locate a 6.5-
foot wide boat in either side yard without significant structural alterations or removal of mature
landscaping.
2. That parking in, or access to, the side or rear yard would not require extensive grading to the side or
rear yard. However, it is not possible to fit the 6.5-foot wide boat in the side yards as there is limited
. space between the existing roof eave and the property line on the westerly side and a fish pond is
located in the easterly side yard.
3. That parking the boat in the front yard will not interfere with visibility to or from Bienvenida Circle in
that the subject property physical characteristics do not create inherent sight distance issues along
the street. The subject property is a key lot adjacent to a reverse corner lot that fronts on and has
a driveway on Alondra Way, so the boat and trailer will not interfere with visibility from the
adjacent property's driveway. Further, the key lot's required front yard setback is 15 feet so
approximately half of the boat and trailer will be parked outside of the front yard setback.
Additionally, the subject property's driveway can adequately accommodate the 18-foot long boat
and trailer without encroaching into the sidewalk and public right-of-way. Therefore, the boat will
not interfere with visibility to or from Bienvenida Circle.

4. That the recreational vehicle in the front yard will not interfere with traffic on the street or sidewalk
or encroach into the street and utility right-of-way in that the driveway of the residence is
approximately 22.67-feet deep as measured from the front property line which is an adequate
depth to park an 18-foot long boat and trailer. The paved driveway, excluding the walkway to the
front door, does not exceed the allowed 24-foot width per Table E of CMC Section 21.44.060 and is
wide enough to accommodate the boat and trailer. Therefore, the boat and trailer comply with
standards and will not encroach into the sidewalk or public right-of-way, thus allowing for street
and sidewalk traffic to proceed unobstructed.
5. That the City Planner has determined that the project belongs to a class of projects that the State
Secretary for Resources has found do not have a significant impact on the environment, and it is
therefore categorically exempt from the requirement for the preparation of environmental
documents pursuant to Section 15061(b}(3} of the state CEQA Guidelines because it can be seen with
certainty that there is no possibility that the activity in question may have a significant effect on the
environment. In making this determination, the City Planner has found that the exceptions listed in
Section 15300.2 of the state CEQA Guidelines do not apply to this project.
Conditions:
1. The boat shall be on the trailer and parked on the westerly portion of the driveway and remain
completely out of the public right-of-way at all times when on-site.
2. The boat is not considered a habitable structure when parked on the property and shall not be used
in such a manner.
3. Approval is granted forV 2019-0002 as shown on Exhibit "A", dated November 21, 2019, on file in the
Planning Division and incorporated herein by reference.
This decision may be appealed by you or any member of the public to the Planning Commission within ten
days of receipt of this letter. Appeals must be submitted in writing to the Planning Commission at 1635
Faraday Avenue in Carlsbad, along with a payment of $876.00. The filing of such appeal within such time
limit shall stay the effective date of the order of the City Planner until such time as a final decision on the
