HomeMy WebLinkAboutHDP 95-08; CARLSBAD CORPORATE CENTRE LOTS 33 & 34; Admin Decision LetterCit July 10, 1995 Four-Sher Development 990 Highland Drive, Suite 202 Solana Beach, CA 92075 • of Carlsbad SUBJECT: CARLSBAD CORPORATE CENTRE -IDLLSIDE DEVELOPMENT PERMIT - HDP 95-08 The City has completed a review of the application for a Hillside Development Permit for grading into an existing manufactured slope which is greater than 15 feet in height and is at a slope greater than 15%. It is the Planning Director's determination that the project is consistent with the City's Hillside Development Ordinance, Chapter 21.95 of the Carlsbad Municipal Code and therefore APPROVES this request based on the following: Findings: 1. The Planning Director has found that, based on the EIA Part II, this Subsequent Project was described in the MEIR 93-01 and EIR 81-06 as within their scope; and there will be no additional significant effect, not analyzed therein; and that no new or additional mitigation measures or alternatives are required; and that therefore this Subsequent Project is within the scope of the prior ErRs, and no new environmental document nor Public Resources Code 21081 findings are required. 2. That hillside conditions have been properly identified on the constraints map which show existing and proposed conditions and slope percentages; 3. The undevelopable areas of the project, i.e. slopes over 40%, have been properly identified on the constraints map; 4. That the development proposal is consistent with the intent, purpose, and requirements of the Hillside Ordinance, Chapter 21.95, in that the project's overall design will blend into the dev.elopment pattern which has been established for the Carlsbad Airport Centre; 5. That the proposed development or grading will not occur in the undevelopable portions of the site pursuant to provisions of Section 21.53.230 of the (::arlsbad Municipal Code, in that the manufactured slope was created by previously authorized grading; 6. That the project design substantially conforms to the intent of the concepts illustrated in the Hillside Development Guidelines Manual, in that the building has been sited to take 2075 Las Palmas Drive • Carlsbad, California 92009-1576 • (619) 438-1161 CARLSBAD CORPORATE CENTER -HDP 95-08 JULy 10, 1995 PAGE 2 advantage of the cut at the toe of slope to preserve the integrity of the top of slope and therefore blend with the manufactured topography; 7. That the project design and lot configuration minimizes disturbance of hillside lands, in that grading quantities are less than 10,000 cubic yards per acre and are will within the acceptable levels established by the Hillside Ordinance. Conditions: 1. Approval is granted for HDP 95-08, as shown on Exhibit "I", dated July 10, 1995, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown on the approved exhibit( s}. Any proposed grading and/or development substantially different from this approval as determined by the Planning Director, shall require an amendment to this Hillside Development Permit.
