A EESOLUTION OF TZIE CITY COUNCIL OF TEE3 CITY OF
VHERXAS, the City Coui?_cil of the City of Carlsbad did, on the 21st
day of April, 1953, pass its 3esolutiol?, of Intention to order the herein-
after described work to be done and improvement to be made in the City
of Carlsbad; and
WHEiZAS, the Director of Public Works of said- City h3.s filed mith
the City Council of said City reports in writing as referred- to in said
Resolution of Intention; and
l\7%=ASy the said Resolution OF intention headed Kotice of Improve-
ment was I?uly and regularly published as required by law, as appears from
the a€fidavit of the Carlsbd. Journal now on flle in the office of the
Clerk of said City; and
TEE3JU.Sy notices of the passage of said Resolution of Intention,
head-ed Motlce of Improvement were duly and regularly posted along the
line of said contemplated work and ixprovement, and in front of all
the property liable to be assessed therefor, and on a.xd along each and
every open street and- highway in the assessmerxt district described in
said. Resolution of Xn%ention, in -tine, form, manner an6 number and at
the required distame, all a.s required by la^, after the passage of
sFid Resolution of Intention, as appears fro= the affidavit of Hapold
H. Barter, who personally posted said notices and who, upon the completion
of the posting of same, forthwith filed his affidavit of so doing in the of-
fice of the City Clerk of said City, making oath 'chat he completed the
posting of said notices on the 2bth day of' April, 1953; and
WI-IZIBAS, no protests or ohjectlons have bee6 presented in the time
an6 manner as required by law, an4 said City Council ylow having acquired
jurisdiction to order the propose6 improvement,
IT IS HZIBBY iXZSULVED, that the public interest axid convenience
require the work to be d-one ar,d inprovencnt to be made in sapid City of
Carlsbad, to-wit:
The installation and maintenance of 8 lighting system for the said
City of Ca.rlsbad, said systen to be lighted from fifteen minutes after
sunset until one-half hour before stinrise each dzy in the year, and
consist of the following:
fifteen 6,000-lwnen lights on the f03-10~~ing streets:
Ponderosa 2ive, Sumach aive , Larch Drive, Terramar Drive,
Los Bobles Drive, an5 E1 Arbol Dr9ve.
The C-ity Clerk is hereby instructed to post a notice of said work,
together with the plans ad speciflca%ions therefor, conspicuously for
five dzys on or riear the council chzmber door of the City Hall of said
City, inviting sealed Troposals or bids for doing the VJOP’U; ordered.
Said Clerk is also directed to pblish once a. notice inviting such
proposals, and referring to the specifications posti;ea or on file, in
the Carlsbad JourmL, a newspaper published ana circulated in said City
and hereby d-esigr-ated for that purpose,
All po3osals or bids shall be accompanied by a check payable to
the City of Carlsbad-, cer”cified- by 3. responsible bank, for 2.n amount
which sha.11 not be Less tha-r? ten. per cent (lo$) of the aggregate of the
bid, or by a bond for the said anount an2 so payable, signed by We bidder
an8- two suweties, who shall justify, before any officey competent to ad-
minister sa oath, in double the said amount, and over and above a11
statutory exemGtions

Said sealed pror>osals or bids shall be delivered to the Clerk of
the Clty of Carlsbad on or before ten o'clock &PI. on Wednesday, the
3r6 day of June, 1953, said- tiae being not less than 20 nor more than
30 clays froin the time of the first posting 2nd publication of the
notice of said work and inviting sealed proposals, on which day and- .
hour all proposals or bids will be publicly opened, by said City Clerk.
PASSED, APPBOVZD ABTD AIEPTZD by the City Couxcll of the city of
Carlsbad this 5th d-ay of Nay, 1953, by the following vote, to-wit:
