Extraordinary Session of 1946, Chapter 20, as generally mended, and
more particularly amended by the Statutes of the 2nd Extraordinary
Session of 1952, Chapter 33, the City of Carlsbad has been allocated the
sum of Sixty-two Thousand ($62,000.00) Dollars by the State Allocation
Boar6 for utilization for the purposes set forth in the above referenced
Act; and
WHEEBAS, the above referenced Act provides that any money appropriated
by this Act for allocation for which application is not made on or before
December 31, 1953, shall revert to the General Fund in the State Treasury;
and
WHEREAS, the Act contemplates that the local agency shall contribute
a share of money exceeding the share which the State has appropriated; and
WHERZAS, the City of Carlsbad, being a newly Incorporated City, in-
corporated on the 16th day of July, 1952, does not possess the required
funds to utilize the State's appropriation of funds; and
WHEREAS, the above referencedxlaw authorizes a local agency to assign
the money allocated to it thereunder, or any portion thereof, to any other
local agency OF governmental unit or district in this State; and
WHERUS, the City of Carlsbad does not have existing sufficient
sewage disposal. facilities and that the City requires additional sewage
disposal facilities; and
WITEE~IUS, it appears that the Carlsbad Sanitary District, a local.
agency within the purposes of the above referenced Act, has indicated
that it can effectively utilize all of the funds appropriated to the
City of Carlsbad by the above referenced Act;
MOW THEREFORE, BE IT RESOLVED, that the City Council of the City of
Carlsbad does hemby assign all the funds which have been allocated it
pwsuant to the provisions of the Statutes of the 1st Extraordinary Session
of 1946, Chapter 20, as amended, to the Carlsbad Sanitary District for
their sole use or for use by the Carlsbad Sanitary District acting in
behalf of the City of Carlsbad.
BE IT FlJEl?HER BESOLVm, that the City Clerk of the City of Carlsbad
is hereby directed to cause a certified copy of this Resolution to be
filed with the Controller of the State of California, the State Director
of Finance, the State AllocatPon Board, and the Carlsbad Sanitary District,
PASSED, APPROVED AND ADOPTm by the City Council of the City of
Carlsbad, California, this 8th day of' June, 1953, by the following vote,

NAYS: None,
ABSENT: Councilman Sutton.
