RESOLUTXON APPOlXTING PERSON TO
(Assessnent District lo. 2-3.567)
RESOLVED, that T. Bruce Smith, be and he is hereby appointed
as attorney to prepare all resolutions, notices and other papers
and proceedings for any work and improvement that may be herein-
after authorized by the City Council of the City of Carlsbad, for
the proposed improvement of Sunnyhill Drive between Alder Avenue
and the Southerly terminus thereof, in the City of Carlsbad; and
BE IT FURTHER RESOLVED, that the said T, Bruce Smith shall
receive as compensation for the doing and performance of said work
the sum of Two Per Cent'(2$) of the contract price, not including
incidentas; but in no event shall the amount of compensation,
which the said T. Bruce Smith shall receive, be less than ONE
EUXDRED DOLLBIis ($lOO.OO)j a~~d
BE IT FURTHER RESOLVED, that said compensation shall be paid
as follows:
(a) Three-fourths (3/4ths) at the time of signing the contpact with the contractor who may be awarded said contract by this Body.
(b) Warrant, diagram and Assessment; The balance thereof at the time of recording the

BE IT FCTRTHER RESOLVED, that if said proceedings shall fail
to be carried through to conclusion, then the said T. Bruce Srnith
shall be paid a reasonable compensation for his services, which
he has performed, not to exceed the sum of ONE HUWDRED DOLLARS
($100.00); and
BE IT FURTHER RESOLVED, that said servfces shall not include
any services for litigation or services in the procurement of
easements or rights of way, but shall be for the preparation of
all resolutions, notices and other papers and proceedings requirec

by the provisions of the Vnprovement Act of 1911” in carrying
through the proceedings for the work herein contemplated,
PASSED, APPROVED AND ADOPTED by the City Council of the Citg
of Carlsbad at a regular meeting held on the 16th day of April,
