RESOLUTION NO. 360
RESOLUTION DECLARING THE RESULTS OF
THE MUNICIPAL ELECTION HELD IN THE CITY OF CARLSBAD ON APRIL 8th 1958, AND DECLARING RESULT OF SAID ELECTION, AND CERTAIN FACTS RELATIVE THERETO.
WHEREAS, pursuant to the provisions and requirements of Sections
9700 to 9920 inclusive of the Election Code of the State of California, a
General Municipal Election was held on the 8th day of April, 1958, in the
City of Carlsbad, State of California; and
WHEREAS, the City Council of the City of Carlsbad met at its usual
place of meeting on Tuesday, April 15, 1958, being the first Tuesday after
the election, and canvassed the return of said election;
NOW, THEREFORE, the City Council of the City of Carlsbad DOES
HEREBY FIND, DECLARE AND RESOLVE that all proceedings required
by the Elections Code of the State of California that relate to municipal
elections, have been performed and held in the manner and form required
by said Elections Code.
IT IS FURTHER RESOLVED AND DECLARED by said Council, that
the canvass of the election returns are herewith declared to be as follows:

That the following measure was voted upon:
PROPOSITION A - CONTRACT AMENDMENT:
Shall the City Council be authorized to amend the Agreement
of Purchase between the City of Carlsbad and the Carlsbad
Mutual Water Company (Dated August 30, 1957 and approved
by the voters of the City December 17, 1957 and on file in
the office of the City Clerk) by striking therefrom the pro-
vision requiring litigation, to wit:
"(c) The power of the City and of the Mutual,
respectively, to enter into, and carry out the
terms of this agreement has been established
by decree of a court of competent jurisdiction"?
IT IS HEREBY RESOLVED AND DECLARED that the following persons
have received the highest vote for the offices set forth after their names:
CARL L. LOUGH Councilman
JANE C. SOPWEMAN Councilwoman
JONATHAN H. PRICE City Clerk
WESLEY F. GREEK City Treasurer
IT IS FURTHER RESOLVED AND DECLARED that the majority of the
votes cast at said election approved the proposition heretofore set forth.
IT IS FURTHER ORDERED at such time as the City Clerk has received
verification that each of the elected candidates has filed a statement of
campaign receipts and expenditures, or the candidates claim for exemption
of such requirement, then the City Clerk shall forthwith issue certificates
of election to the candidates named above, and the City Clerk shall administel
to each person elected the oath of office prescribed in the State Constitution.
PASSED, APPROVED AND.ADOPTED at a regular meeting of the
City Council held on the 15th day of April, by the following vote, to wit:
