RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD PERMIT-
TING TEMPORARY S
BE CONSTRUCTED IN THE BUENA VISTA WATER SH UPON CERTAIN STATED CONDITI
ER PI&" TO
WHEREAS, certain subdividers have proposed to construct a sewer plant
either temporary or permanent in nature in the Buena Vista Water shed; and
WHEREAS, the site of said proposed plant has been annexed to the City
of Carlsbad, which annexation is currently subject to dispute by the City of
Oceanside; and
WHEREAS, the subdividers have requested the City of Carlsbad to
permit a temporary plant at the proposed site; and
WHERELAS, the City of Garlsbad is informed and believes that the
Sewer Committee of the City of Oceanside on the 26th day of May, 1958,
assuming that said plant were to be built in Oceanside, proposed that said
plant be made available in part to the City of Carlsbad and to adjacent unin-
corporated areas; and
WHERGAS, the Gity of Garlsbad is willing to have said proposed plant
be made available in part to the City of Oceanside and the adjacent unincorpo:
ated areas; and
WHEREAS, it appears that the common intention of both cities would be
fulfilled if the proposed sewer plant were jointly owned by the City of Garlsbz
and the Gity of Oceanside;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF CARLSBAD AS FOLLOWS:
1. That the City of Carlsbad shall permit the construction of a tempora
sewer plant on that particular twelve x12) acres (approximately) owned in fee
by the City of Oceanside, which lies southerly of and adjacent to California
State Highway 78, subject to the following terms and conditions:
a. That the engineering design and type of plant be first
approved by the City Council of the City of Carlsbad,

b. That the Ci'ty of Garlsbad, either through its Planning
Commission or City Council, grant a Conditional Use
Permit for such purpose pursuant to the procedures
and provisions of local ordinance and State law,
That the City of Oceanside deed to the City of Carlsbad
an undivided one-half interest in the proposed sewer

plant site.
PASSED, APPROVED AND ADOPTED by the City Council of the City of
Carlsbad at a regular meeting held on the 2nd day of September, 1958, by the
following vote, to wit:
AYES: Mayor Lough, Councilmen Ledgerwood, Helton, Grober, and
Councilwoman Sonneman.
NOES: None
ABSENT: None
