RESOLUTION NU. 487
RESOLUTION OF THE CITY OF CARLSBAD AMENDING THE MASTER CIVIC CENTER
PLAN FOR THE CITY OF CARLSBBD, BY
DELETING CERTAIN PROPERTIES THEREFROM.
WHEREAS, on the 4th day of March, 1958, the City Council of the
City of Carlsbad adopted Resolution No. 349, adopting a Master Civic Center
Plan; and
WHEREAS, on the 16th day of September, 1958, the City Council of
the City of Carlsbad adopted Resolution No. 440 stating its intention to amend
the Master Civic Center Plan by excluding certain areas therefrom; and
WHEREAS, on the 14th day of October, 1958, the Planning Commissioi
of the City of Carlsbad adopted Resolution No. 89, recommending that subject
properties be not excluded from the Master Civic Center Plan; and
WHEREAS, on the 7th day of November, 1958, the City Council, as
the original applicant for the change, appealed the decision of the Planning
Commission; and
WHEREAS, on the 2nd day of December, 1958, the City Council
considered said appeal and stated its intention to overrule.the Planning Com-
mission; and
WHEREAS, on the 8th day of December, 1958, the City Council
notified the Planning Commission that it had considered the appeal and re-
quested a report from the Planning Commission; and
WHEREAS, more than forty (40) days have elapsed since said
notification and no report has been received from the Planning Commission.
NOW, THEREFORE, the City Council of the City of Carlsbad DOES
HEREBY FIND AND DECLARE as follows:
1. That the properties hereinafter described are not essential to the
Master Civic Center Plan as there is another location that has been acquired
by the City of Carlsbad that could be used as a Library, said properties being
more particularly described as follows:

Parcel 1. Assessor's Parcel No. 35-45-3, being a portion of Carlsbad Lands, Tract 117, more particularly described as follows:
Beginning on the northerly li of Tract 117, north
89" 57' west 358.58 feet from the nartheast corner;
thence north 89" 57' west 108 feet; thence south
34" 33' east 250.58 feet; thence north 55" 27' east
88.90 feet; thence north 34" 33' west 189.55 feet to point of beginning.
Parcel 2. Assessor's Parcel No. 35-45-4, being a portion of Carlsbad Lands, Tract 117, more particularly deseribed as follows:
Beginning at the northeast corner of Tract 117; thence
north 89" 57' west on the northerly line 358.58 feet;
thence south 34" 33' east 342.91 feet to a point on the southeasterly boundary; thence north 55" 27' east on the southeasterly boundary to the southeast corner of said tract; thence north 0" 52' west along the easterly line 167.40 feet to beginning, EXCEPTING roadway.
2, That it would save the City of Carlsbad approximately $100,000.00
if they would use properties other than the above described properties for
Library purposes.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad that the above described properties be, and they are hereby
deleted from the Master Civic Center Plan of the City of Carlsbad.
BE IT FURTHEX RESOLVED that the City Clerk of the City of Carlsb
is hereby directed to cause the Master Civic Center map to be changed by
deleting therefrom the above described properties, and to endorse upon said
nap the adoption of this resolution.
PASSED, APPROVED AND ADOPTED by the City Council of the City
of Carlsbad at a regular meeting of the City Council held on the 3rd day of
February, 1959, by the following vote, to wit:
AYES: councilmen Grober, Sonneman, Ledgerwood and Coats.
NOES None
ABSENT: Councilman Helton /-
