A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARZSBAD, CALIFORNIA, ORDERING, CALLING, PROVIDINQ FOR AND GIVING NWICE OF A SPECIAL MCTNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, JULY 28,1959, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY A PROPOSITION FOR THE ISSUANCE OF WATER FBVENUH- BONDS BY SAID CITY AND CONSOLIDATXNG SAID ELECTION WITH THE SPECIAL MUNICIPAL ELEZTION TO BE HELD IN SAID CITY ON SAID DATE.
The City Council of the City of Carlsbad, California,
DOES HEREBY RESOLVE, DETERMINE AN9 ORDER as follows:
Section 1. That a special election be held and
the same is hereby called to be held in the City of Carlsbad,
California, on Tuesday, the 28th day of July, 1959, for the
purpose of submitting to the qualified voters of said city
the proposition of issuing water revenue bonds pursuant to
the Revenue Bond Law of 1941 (Chapter 6, Part 1, Division 2,
Title 5 of the Government Code of the State of California)
in the amount and for the objects and’purposes hereinafter set
forth, including all expenses incidental thereto or connected
therewith.
Section 2. That the purpose for which said bonded
indebtedness is to be incurred and revenue bonds issued there-
for is as follows:
The acquisition, construction and financing
of extensions, enlargements and improvements of
the water system of the City of Carlsbad, including
eo
works and facilities for the storage, transmission
and distribution of water, the reconstruction of
parts of said system, and the acquisition of land,
easements, rights of way and other property
necessary therefor, and including all engineering,
inspection and legal fees, costs of the issuance of
said revenue bonds, bond reserve funds, and other
costs and expenses incidental to or connected with
suoh acquisition, construction and financing.
Section 3. That the estimated cost of such acquisi-
tion, construction and financing is $300,000. That the princi-
pal amount of the bonds proposed to be issued is $300,000,
That the maximum rate of interest to be paid on said bonds
shall not exceed the maximum rate permitted by law, to wit,
six per cent (6s) per annum, payable annually for the first
year and semiannually thereafter, the actual rate or rates of
interest on said bonds to be determined at or prior to the
time of the sale or sales thereof.
Secttion 4. That if the proposition for the incurring
of bonded indebtedness so submitted receives the requisite
number of votes, to wit, the votes, of a majority of all the
voters voting on the proposition, revenue bonds as provided
herein in not exceeding the principal amount stated in such
proposition shall be issued and sold for the purpose set forth
herein, Said bonds are to be revenue bonds payable exclusively -
from the revenues of the enterprise and are not to be secrured
by the taxing power of the City of Carlsbad.
Section 5. That the enterprise referred to herein is
defined to be the entire water system of the City of Carlsbad
including all improvements and extensions later constructed
or acquired.
Section 6. That the polls for said election shall
be opened at seven o'clock A.M., of the day of said election
and shall remain open continuously from said time until seven
o'clock P.M., of the same day, when said polls shall be
closed, except as provided in Section 5734 of the Elections
Code of the State of California.
Section 7. That on the ballots to be used at said
special election, in addition to any other matter required by
law, there shall be printed substantially the following:
MARK A CROSS (+) ON BALLOT ONLY WITH RUBBER STAMP; NEVER WITH PEN OR PENCIL.
(ABSENTEE BALLOTS MAY BE MARKED WITH PEN AND INK
OR PENCIL.)
INSTRUCTIONS TO VOTERS
To vote on any measure, stamp a crost (+A in the voting square after the word YES or after the word 'NO". All marks, except the cross (+) are forbidden. All distinguishing marks or erasures are forbidden and make the ballot void.
If you wrongly stamp, tear or deface this ballot, return it to the inspector of election and obtain another.
On absent voter ballots mark a cross (+) with pen or pencil.

Section 8. A cross (+) placed in the voting square
after the word WE5’t in the manner hereinbefore provided
shall be counted in favor of the adoption of the proposition.

Section 9. That the manner of holding the election
shall be as - provided in this resolution and the manner of
voting on the Issuance of bonds shall be as provided in this
resolution.

in all respects as if there were only one election, and only
one form of ballot shall be used thereat. The precincts,
polling places, and officers of election for this special
election shall be the same as those provided for said
special municipal election, and said precincts, polling
places and officers of election are set forth in the ordinance
providing for said special municipal election, to wit,
Ordinance No. 1065 , adopted June 16, 1959, and entitled
"An ordinance of the City of Carfsbad, California, ordering,
calling, providing for and giving notice of a special election
to be held in the City of Carlsbad on the 28th day of auly,
1959, for the purpose of submitting to the qualified voters
of said city three propositions to incur bonded indebtedness
by said city for certain municipal improvements.
