The City Council of the City of Carlsbad, California, DO= HBREBY RESOLVE, DETERluiINE AND ORDER as f OlXOWS : Section 1. That a special election be held to the qualified voters of said city a proposition for the enactment of a certain ordinance, to wit: Attached hereto, marked Exhibit A, and made a part hereof 0. at such election said ordinance shall be enacted accordingAy. Section 2. That the polls for said election shall be opened at seven o'clock A.M. of the day of said election and shall remain open continuously from said time untiP seven olclock P,M, of the same day, when said polls shall be closed, except as provided in Section 5734 of the Elections Code of the State of Califomia. Section 3. Except as otherwise provided in this resolution, the election called hereby shall be held and conducted and the votes canvassed pursuant to law for general municipal elections held in the City of Carlsbad, Section 6. That the special election hereby called shall be and is hereby ordered consolidated with the special municipal election to be held in said city on Tuesday, the 28th day of July, 1959, and such elections shall be held in a13 respeGts as if there were only one election, and only one form of ballot shall be used thereat. The precincts, polling places and officers of election for this special election shall be the same aa those provided for said special municipal election, and said precincts, polling places and officers of election are set forth in the ordinance providing for said special municipal election, to wit, Ordinance No. 1065 , adopted JunelB, 1959, and entitled "An ordinance of the City of Carlsbad, California, ordering, calling, providing for and giving notice of a special election to be held in the City of Carlsbad on the 28th day of July, 1959, for the purpose of submitting to the qualified voters of said city three propoaitions to incur bonded indebtedness by said city for certain munici- pal improvements. 'l Section 7. That the City Clerk shall publish notice of this election substantially-in the form set forth in Elections Code 9751 (except that the officers shall be omitted) once in the CARLSBAD JOURNAL, a..news- paper of general circulation published and circulated in said city, not later than the fifty-fourth (54th) day before said election. Not later than forty election said City Clerk shall (40) days prior publish in said to said newspaper 0. 0. a notice substantially in the form provided in Elections Code Section 9754.1, except that said precincts, polling places and election officers shall be referred to by reference as set forth in this resolution. Said City Clerk shall publish in said newspaper at least twice before the day of election a notice sub- stantially in the form required by,Elections Code Sec- tion 9755, the synopsis to be the ballot proposition herein set forth, upon its Section 8. The People of the City of Carlsbad, California, DO ORDAIN as follows: SECTION 1. Sewer Fund, the Permissible Uses Thereof. All funds and moneys received from the collection of sewer service charges shall be deposited with the City Treasurer of the City of Carlsbad, who shall establish and maintain a separate fund and account to be known as the "Sewer Fundrr. Out of the Sewer Fund, to the extent that moneys are avail- able therefor, there shall be paid only the following in the order set forth: (a) The necessary and reasonable maintenance and oper- ation costs of said sewer system. (b) The principal of and interest on bonds issued for setiler purposes. (c) Any payments specifically authorized or required by the City Council in any ordinance or resolution pro- viding for the issuance of said bonds, (d) Amounts, as the City Council may direct, for the payment of the costs of extensions and improvements of or additions to said sewer system or €or any other sewer pur- pose. n ces For the purpose of the administration of the Sewer Fund ary and desirable sub funds and/or accounts may be used to show receipts, expenditures and balances, EXHIBIT ''A"
