RESOLUTION NO, 635
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, DENYING AN
APPEAL FOR A CHANGE OF ZONE FROM
AT THE SOUTHWESTERLY INTERSECTION OF ROOSEVBLT STREET AND MAGNOLIA AVENUE BETWEEN THE A.T, & S.F. RAILWAY AND JEFFERSON STREET, IN THE CITY OF
CARLSBAD.
ZONE R-1 TO R-3 ON PROPERTY LOCATED
WHEREAS, on the 22nd day d December, 1959, by Resolution No. 141,
the Planning Commission of the City of Carlsbad denied an application for a
change of zone from Zone R-1 to Zone R-3 of that property in the City of
Carlsbad, described as:
Property located at the southwesterly intersection of Roosevelt Street and
Magnolia Avenue between the A. T. & S, F. Railway and Jefferson Street, more
particularly described as Tax Assessorcs
Parcel 1, Page 133, Book 35 of the Assessor's Map of San Diego County, and being a portion
of Tract 231, Thum Lands, according to Map
1681 in the City of Carlsbad.
WHEREAS, on December 29, 1959, the applicant for the zone change
filed an appeal with the City Council for the purpose of reconsidering the actio]
of the Planning Commission, of which appeal was duly advertised in the manne
prescribed by law; and
WHEREAS, on the 19th day of January, 1960, a public hearing was held
by the City Council of the City of Carlsbad to consider said appeal, and at
said hearing the Council continued the matter to March 1, 1960.
NOW, THEREFORE, the City Council of the City of Carlsbad does hereby
find as follows:
a. If the rezoning as requested were granted, it would only be
piecemeal rezoning and could lead to further developemant
which would landlock certain parcels in the area under
consideration.
b. It is in the best interests of the City that no rezoning take
place in this area until such time as an acceptable precise
plan can be presented to the Commission and adopted by the
city.

The City Clerk is hereby directed to cause a copy of this resolution to
be mailed to Archie and Fawn A. Koyl, 834 North Pickering, Whittier,
California.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City
Council of the City of Carlsbad, held on the 1st day of March, 1960, by the
following vote, to wit:
AYES: Councilmen Grober, McPherson and La Roche,
NOES: Councilmen Ledgerwood and Sonneman.
ABSENT: None.
