RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD DECLARING FINDING THAT OWNERS OF MORE TKtZN
60% IN AREA OF THE PROPERTY SUBJECT
TO ASSESSMENT IN PROPOSED ASSESSMENT DISTRICT NO. 1-1960 HAVE SIGNED PETITION FOR IMPROVEMENTS; FINDING THAT THE PETITION FOR PROPOSED ASSESSMENT DISTRICT NO, 1-1960 HAS BEEN FILED WITH
THE CLERK OF THE CITY OF CARLSBAD; AND FINDING THAT SAID PETITION CONTAINS A W-AIVER OF INVESTIGATION PROCEEDINGS REQUIRED BY DrVISIOM 4 F THE STREETS AND HIGHWAY CODE OF THE STATE OF CALIFORNIA.

WHEREAS, on the 16th day of May, 1960, a petition was filed with the
City Clerk of the City of Carlsbad, said petition bearing the date of April 11,
1960, wherein the petitioners requested the improvement of Chestnut Avenue
from its intersection with Pi0 Pic0 Drive to a point 123.50 feet east of the
centerline of Monroe Street, to construct 5' P, C. C. sidewalks, concrete
combination curb and gutter, concrete cross gutters, drainage structures
and appurtenances thereof, asphaltic concrete pavement and select subbase,
sewer laterals as needed, resetting of property fences and concrete retaining
walls; and
WHEREAS, the City Engineer of the City of Carlsbad has filed with
the City Council his report stating that owners of more than 60% in area of the
property subject to assessment for such proposed improvement have signed
said petition; and
WHEREAS, it appears from the face of said petition that the signers
thereof have waived the investigation proceedings required by Division 4 of
the Streets and Highway Code of the State of California,
NOW, THEREFORE, the City Council of the City of Carlsbad does
hereby resolve and find as follows:
I. That said petition has been filed with the Clerk of the City of Carlsbac
on the 16th day of May, 1960.
2. That said petition bears the signatures of the owners of more than

nent.
3. That said petition waives investigation proceedings as required by
Xvision 4 of the Streets and Highway Code of the State of California.
BE IT FURTHER RESOLVED by the City Council of the City of Carlsbad
hat said petition is hereby accepted, EXCLUDING the following items of
mprovement, which will be done by the City of Carlsbad with gas tax funds:
1. Concrete cross gutters and spandrels;
2. Drainage structures and appurtenances thereof;
3. Asphaltic concrete pavement and select subbase.
PASSED, APPROVED AND ADOPTED by the City Council of the City
of Carlsbad at a regular meeting held on the 8th day of June, 1960, by the
following vote, to wit:
AYES: Councilmen Guevara, Bierce, Sonneman, McPherson and La Roche
