RESOLUTION NO, 673.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD APPOIWTIMG
PERSON TO ACT AS ENGINEER OF WORK, DESIGNATING ENGINEER OF WORK AS THE PEZSON RESPONSIBLE FOR PREPARATION
OF THE ENGJlYEERIMG DOCUMENTS, ASSESS-
MENT DUGRAMS, ASSESSMENT ROLL AND WARRANT; DESIGNATING THE ENGINEER OF WORK TO SUPERVISE ALL WORK; APPOINT-
ING mGINEER OF WORK AS THE SUPERIN-
TENDENT OF STREETS AND FIXING COMPEN-
SATION FOR SERVICES,
(Assessment District No. 2- 1960)
RESOLVED by the City Council of the City of Carlsbad that CLYDE L,
JENKEN be, and he is hereby appointed Engineer of Work for the proposed
doing of all necessary engineering work and exercising all of the functions
provided for the office of Bhgineer of Work and Superintendent of Streets in
the "Improvement Act of 1911" in connection with the improvement work in
the City of Carlsbad, and to be known as the improvement of ValIeySaeet-.
between Basswood Avenue and Chestnut Avenue.
BE IT FURTHER RESOLVED that said Clyde L. Jenken shall act as
Engineer of Work and Superintendent of Streets and is hereby employed
and appointed to furnish all surveys, original drawings, maps and blue prints.
including any and all such maps necessary and incident to the rights of way
comtemplated in the improvement work herein involved; all plans and specifi-
cations, all inspection work, preparation of assessment rolls, assessment
diagram and warrant and any and all other services which shall be required
from the Engineer of Work and/or Superintendent of Streets under the pro-
visions of the "Improvement Act of 1911"; and
BE IT FURTHER RESOLVED that said Clyde L. Jenken, is hereby
appointed as the person to supervise, inspect, and accept in behalf of the
City of Carlsbad the installation, construction, performance and completion
of such work and improvements,
BE IT FURTHER RESOLVED that said Clyde L. Jenken, Engineer of
Work, is hereby appointed to act in the name, place and stead of the
Superintendent of Streets", as such name and title appears under the provi- 11
sions of the "Improvement Act of 1911".

BE IT FURTHER RESOLVED that for such services that the said
CLYDE L, JENKEN, acting in his capacity as Engineer of Work and Superin-
tendent of Streets, shall receive as and for his compensation for the services
so specified, and as provided by law, the following compensation, which shall
consist of the following sums of money:
Ca) Six per cent (6%) of the contract price for engineering services,
(b) Two per cent (2%) of the contract price for preparation of Assessment, Assessment Roll, Assessment Diagram, and
Warrant.
BE IT FURTHER RESOLVED that of the compensation so allowed to
said CLYDE
General Fund of the City of Carlsbad and one-fourth (1/4th) shall be payable
to CLYDE L. JENf;CEN.
JENKEM that three-fourths (3/4ths) shall be paid to the

contract price without incidentals, and in the event the proposed proceedings
herein contemplated shall be defeated or for any reason fail of consummation,
the said CLYDE L. JENKEN shall be paid a reasonable compensation for his
services which he has performed, and which in no event shall be less than
$100,00,
BE IT FURTHER RESOLVED that tk fees herein provided to be paid
to the said Engineer shall be payable as follows:
Three-fourths (314th~) of the Engineering fee upon awarding and signing of contract for the work.
The balance of said Ehgineering fee, and other fees herein provided for, upon the confirmation of the assessment and delivery of the Warrant,
PASSED, APPROVED AND ADOPTED by the City Council of the City
of Carlsbad at a regular meeting held on the 16th day of August, 1960, by the
following vote, to wit:
AYES: Councilmen Cuevara, Bierce, Sonneman and McPherson,
NOES: None
ABSJ3NT: Councilman La Roche.
