A RESOLUTION OF THE CITY COUMCIL OF THE CITY OF CARLSBAD APPOINTING PEWON TO ACT AS ENGINEER OF WORKr DESIGNATING ENGINEER OF WORK hLs THE PERSON RESPONSIBLE FOR PREPAEUkTXON OF THE ENGINEERING DOCUmTS, ASSESS- MENT DIAGFLAMS, ASSESSMENT ROLL AND WAl3l3-T~ DESIGNATING TI333 ENGINEER OF
WORK TO SUPERVISE ALL WORlQ APPOINT- ING ENGINEER OF WORK A15 THE SWPEFUN- TENBENT OF STWETS AND FIXING COMPEN-
SATION FOR SERVICES
(Proposed Assessment District No. 1-1961)
RESOLVED by the City Council of the City of Carlsbad that LOWELL A.
RATHBUH be, and he is hereby appointed Engheer of Work for the proposed
doing o€ all necessary engineering wopk and exer
provided for the office of Engineer of Work and Superintendent of Streets fn
the "Improvement Act of 1911. '* in connection with the improvement work in
g all of the functions
the City of Carlsbadp and to be known as the hprovement of Eureka Place
between Chesbut Avenue and Basswood Avenue.
BE IT FURTHER RESOLVED that said Lowell A. Rathbun shall act as
Engineer of Work and Superintendent of Streets and is hereby employed and
appohted to furnish all suryeysI original. drawings, maps and blue prints,
including any and all such maps necessary and incident to the rights of way
contemplated in the improvement work herein involved; all plas and specifica-
tions, aU inspection work, preparation of assessment rolls, assessment
diagram and warrant and any and all other services which shall be required
from the Engineer of Work and/or Superintendent of Streets under the pro-
visions of the "Improvement Act of 1911"; and
BE IT FURTHER RESOLVED that said LQwell.A
appohted as the person to supervisel inspect, and accept in behalf of the
City of Carlsbad the bstallaaon, construction> performance and completion
af such work and improvements.
BE IT FURTHER RESOLVED that said Lowell A. Rathbun, Engineer of
Work, is hereby appointed to act in the name, place and stead of the
''Superintendent of Streets", as such name and title appears under the provisioi

of the "Improvement Act of 1911",
BE IT FURTHER RESOLVED that for such services that the said
LOWELL A. RATHBUN# acUng in his capacity as Engineer of Work and Supera
intendent of Streets, shall receive as and for his compensation for the services
so specified, and as provided by law, the following compensation, which shall
consist of the following sums of money:
(a) Six per cent (67ka) of the contract price for engineering services.
(b) Two per cent (2%) of the contract price for preparation of Assessment, Assessment Roll, Assessment Diagram, and Warrant.
BE IT FURTHER RESOLVED that of the compensation so allowed to
said Lawell A. Rathbun as provided by law, shall be payable to the General Fur:
of the City of Carlsbad,
BE IT FURTHER RESOLVED that said sum shall be based upon the
contract price without incidentals, and in the event the proposed proceedings
herein contemplated shall be defeated or for any reason fall of consummation,
the said Lowell A. Rathbun shall be paid a reasonable compensation for his
services which he has performed, and which in no event shall be less than
$lQO. 00.
BE IT FURTHER RESOLVED that the fees herein provided to be paid
to the said Engineer shall be payable as follows:
(a) Three-fourths (3/4ths) of the Engineering fee upon - awarding and signing of contract for the work,
(b) The balance of said Engineering fee, and other fees herein provided for, upon the confirmation of the assessment and delivery of the warrant ,
PASSED,- APPROVED AND ADOPTED by the City Cowcil of the City
of Carlsbad at a regular meetlng held on the 2nd day of May, 1961, by the
