City of Carlsbad State of California
WHEREAS, the application of The Atchison, Topeka
and Santa Fe Railway Company for authority under Section 5
(2) of the Interstate Commerce Act to acquire control of
the Western Pacific Rsllroad Company by purchase and
exchange of its capital etock, Finance Docket No, 21334,
was filed with the Interstate Commerce Commi.ssion 03
October 25, 1960;
WFEREAS, application of the Southern Pacific Company
for authority under Section 5 (2) of the 1ntersZ;ate
Commerce Act to acquire control of the Western Pacific
Railroad Company by purchase of its capital stock, Finance
Docket IYo. 21314, was filed with the Interstate Commerce
Commission on October 12, 1940;
WmREi?S, the application of The Atchison, Topeka
and Santa Fe Railway Company states that control by It will
(1) affirmatively contribute to adequate transportation
service by cssuring continuation of aggressive competition
in the dyntmically expending area immediately affected and
(2) by preservtnp and fostering, established gateways and
routes via which the increased traffic deaands of the crea
nay be rrlet In the future;
WHEREAS, the economic interest and the public welfare
of the City of Carlsbad fs directly related to the preserva-
tion of competftive railroad service in California and the
Far Mest and the preservation and furkher use of competitive
rail gateways and f'acPlities and competitive rail routes
to and frox Calff'ornia, the Pacific I\jorthmst, the South
and the East;
WEEREliS, the continuation of' Western Pacific as a
railroad service dfrectly competitive to the service
offered by the Southern Pacific Company wi31 enabLe this
City and its surrounding erea to continue to improve its
industrial, coinmercial and agricultural growth;
WHEREX3, the economic success and the futare fndus-
trial development of this City depend, in large measure,
upon the qualZty and efficiency of the railroad service,
routes and gateways available to its present and future
indus tri es ;
WHEREhS, the economic self-interest of the Southern
Pacific Company as owner of the Western Pacific Railroad
Company does not provide a basis for the accomplishment of
the objectives to which the interests of' this City are
directly related; and
Wf-rEREAS, control, of the Western Pacific Railroad
Company by the Southern Pacific Company would not oply
preclude the realization of the benerfts flowing from the
accomplishment of these objectives but would have 8 dis-
advantageous effect upon the economy of this City.

NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Carlsbad, County of San Diego, State of
California, hereby gives its full support to the application
of The Atchison, Topeka and Santa Fe Railway Company to the
Interstate Commerce Commission for approval of its plan for
control of the Western Pacific Railroad Company.
NOW, THERFORE, BE IT FURTHER RESOLVED that the City
Council of the City of Carlsbad, County of San Diego,
State of California, is opposed to the application of the
Southern Pacific Company to the Interstate Commerce
Commission for approval of its plan for control of the
Western Pacific Railroad Company,
BE IT FURTHER RESOLVED that the City Manager ofthis
City be and is hereby authorized and directed to sign, verify
and file on behalf of this City a petition for leave to
intervene in support of the application of The Atchfson,
Topeka and Santa Fe Railway Company and in opposition to
the application of the Southern Pacific Company, and to
take all reasonable steps in furtherance of the interests
of this City in the proceeding or proceedings before the
Interstate Commerce Commission,
