RESOLUTION NO,, 813.
RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF CARLSBAD ANNOUNCING
FINDINGS AND DECISION RECARDWG CHANGE OF ZONE CLASSIFICATION OF CERTAIN DESIGNATED PROPERTY IN THE CITY OF CARLSBAD FROM ZONE R-1 TO ZONE R-3 AND C-1.
WHEREAS, on the 13th day of February, 1962, the Carlsbad City Planning
Commission adopted Resolution No. 235, which is herewith referred to and
made a part hereof; and
WHEREAS, on March 6, 1962, a duly advertised public hearing was held
as prescribed by law to consider the reclassification from Zone R-1 to Zone
R-3 of property described as:
Portion of Alles Avocado Acres Resubdivision, Block B,
Map No. 2027, Book 204, Page 222, Parcels 1, 2, 3, 4, 5 and 6, and Book 205, Page 200, Parcels 1, 7 and 8 of the Assessorls Map of San Diego County; Tract 236 Thum Lands, Parcels
No. 2, 3, 4 and 20, Book 205, Page 270 of the Assessor's Map of San Diego County; and Tract 237, Map 1681, Thum L
Book 206, Page 050, Parcels 4, 5 and 6 of the Assesso
of San Diego County; and
from Zone R-1 to Zone C-1 of property described as follows:
The westerly 225I of Parcels 1 and portion of 2 combined, Book 206, Page 050 of the Assessor's Map of San Diego County having a line drawn parallel with and distant 225r perpendicular from the easterly right-of-way line of Pi0 Pic0 Drive and 376t plus southerly of Tamarack.
The balance of Lot 2 is to be R-3 excepting the 105f westerly and parallel to the westerly right-of-way of Adams Street
which is to remain R-1;
and
WHEREAS, said anning Commission has found the following facts to
exist:
1. That the granting of this zone reclassification from R-l to R-3
would act as a buffer strip between the R-1 and C-1 zone.
2. That it wodd enable development to attract tourist traffic off
the U. S. 101 Freeway into Carlsbad.
3. That such reclassification will not adversely affect the compre-
hensive general plan.
4. That it would be the best usage of the land and would be compatiblc

with surrounding property.
5. That it is advantageous to rezone before other development of
surrounding property would make this zoning incompatible.
City ,Council received all recommendations and heard all
persons interested in or opposed to the proposed change of zone classification.
NOW, THEREFORE, the City Council of the City of Carlsbad DOES
HEREBY DECLARE FINDINGS AND RESOLVE that the findings of the Plannin
Commission contained in Resolution No. 235 constitute the findings of the City
Council of the City of Carlsbad.
BE IT FURTHER DECLARED AND RESOLVED that the City Council
certified that the approval of the proposed change of zone classification is
necessary to carry out the general purpose of Ordinance No. 9060 as amended.
BE IT FURTHER RESOLVED that the City Council does hereby declare
its intention to adopt an ordinance to effectuate the proposed change of zone
classification.
BE IT FURTHER DECLARED AND ORDERED that the City Attomey is
hereby instructed to prepare an ordinance amending Ordinance No. 9060 to
effectuate the change of zone classification.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City
Council held on the 6th day of March, 1962, by the following vote, to wit:
AYES: Councilmen Guevara, Bierce, La Roche, Sonneman and McPherson.
NOES: None
ABSENT: None
