venience to grant the variance as requested.
2. That it would not be deterimental to public necessity and convenience
to allow a variance with a frontage on Chestnut Avenue of 60' af; the easterly lot
after the lot split, to a depth of 35f, then a 10* easterly jog in the westerly
property line of said easterly lot, and then extending to the rear property line
with a width of 50' of said easterly lot.
3. That the granting of such variance retaining the minimum 60' frontage
to a depth of 35' will not adversely affect the comprehensive general plan.
4. That the approval of the application in the variance granted herein be,
and it is hereby subject to the monumentation as required by the City Engineer.
NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERECl
that the appeal for a variance be, and the same is hereby allowed as follows:

WHEREAS, on the 22nd day of May, 1962, the Planning Commission of
the City of Carlsbad adopted Resolution No. 247, which denied a variance
applied for by HARRY F. AND LA VERNE R. KELLEYj and
WHEREAS, on the 23rd day of May, 1962, Harry F. and La Verne R.
Kelley appealed to the City Council to review the action of the Planning Commis
sion; and
WHEREAS, on the 19th day of June, 1962, the City Council of the City of

BE IT FURTHER RESOLVED AND ORDERED that the City Clerk send
a duly certified copy of this resolution to the applicant at the address shown on
the application; that a copy hereof be mailed to any other parties requesting
notice of this action, and that a copy be attached to the Planning Commission
file and made a permanent part thereof.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City
Council held on the 3rd day of July, 1962, by the following vote, to wit:
AYES: Councilmen Guevara, Bierce, Meiswender and Hughes.
NOES: None
ABSENT: councilman McPherson
