RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF CARLSBAD DECLAPlIING
FINDING THAT OWNERS OF MORE TIlAN 60% IN AREA OF THE PEOPERTY SUBJECT
TO ASSESSMENT IN PROPOSED ASSESSMENT DISTRICT NO. 2-1962 €LAVE SIGNED PETITION FOR IP~/IPROVEMENTSJ FINDING THAT THE PET1 TION FOR PROPOSED ASSESSMENT DISTRICT NO. 2-1962 I-ZAS BEEN FILED WITH THE CLERK OF THE CITY OF CARLSBAD;
AND FINDING THAT SAID PETITION CONTAINS A WAIVER OF INVESTIGATION PROCEEDINGS REQUIRED BY DIVISION 4 OF THE STREETS AND HIGHWAY CODE OF THE STATE OF CALIFORNIA.

WHEREAS, on November I, 1962, a petition was filed with the City Clerl
f the City of Carlsbad, said petition bearing the date of October 6, 1962, whereilc
le petitioners requested the improvement of Harding Street from its intersection
lth Grand Avenue to its intersection with Magnolia Avenue; Oak Avenue,
!hestnut Avenue, Palm Avenue with their intersections with Harding Street to
ieir terminus with State Highway XI-SD-2B; Pine Avenue from its intersection
ith Madison Street to its terminus with State Highway XI-SD-2B; and Magnolia
.venue from its intersection with Jefferson Street to its terminus with State
Xghway XI-SD-2B, to construct concrete sidewalks, combinatim concrete curb
nd gutter, concrete cross gutters, drainage structures and conduits, asphaltic
oncrete pavement with base and seal coat, sewer service laterals as needed,
oncrete driveway approaches, and other appurtenant work for permanent street
nprovement; and
WHEREAS, the City Engineer of the City of Carlsbad has filed with the
Xty Council his report stating that owners of more than 60% in area of the
roperty subject to assessment for such proposed improvement have signed said
letition; and
WHEREAS, it appears from the face of said petition that the signers
hereof have waived the investigation proceedings required by Division 4 of the
ltreets and Highway Code of the State of California.
NOW, THEREFORE, the City Councll of the City of Carlsbad does

hereby resolve and find as follows:
1. That said petition has been filed with the Clerk of the City of Carlsba
on the 1st day of November, 1962.
2. That said petition bears the signatures of the owners of more than
60% in area of the property subject to assessment for said proposed improve-
ment.
3. That said petition waives investigation proceedings as required by
Division 4 of the Streets and Highway Code of the State of California.
BE IT FURTHER RESOLVED by the City Council of the City of Carlsba
that said petitian is hereby accepted, EXCLUDING the following items of
improvement, which will be done by the City of Carlsbad from the Parks and
Boulevard tax funds:
1. Concrete cross gutters and spandrels;
2. Drainage structures and appurtenances thereof;
3. Asphaltic concrete pavement and select subbase.
PASSED, APPROVED AND ADOPTED by the City Council of the City
of Carlsbad at a regular meeting held on the 7th day of November, 1962, by the
EoUowing vote, to wit:
