HomeMy WebLinkAbout1963-04-26; City Council; Resolution 895e RESCLUTION NO, 895 RESOLUTION DETERMINING INITIAL VIEW OF LEGISLATIVE BODY THAT THE PROVISIObJS OF DIVISION 4 OF THE STREETS AND 1911 IMPROVEMENT DISTRICT. HIGHWAYS CODE WILL NOT BE VIOLATED - CHINQUAPIN AVENUE (Assessment District No. 1-1962) WHEREAS, on the 26th day of April , 1963, the City Council of the City of Carlsbad, California, adopted its Resolution No, 894 , entitled "Preliminary Determination r-.C >'ti/ of Legislative Body Under "Special Assessment Investigation, Limitation and Majority Protest Act of 1931"," in accordance with Sections 2820, 2821, 2822 and 2823 of said Act; NOW, THEREFORE, IT IS HEREBY RESOLVED and determined by the City Council of the City of Carlsbad that after taking the steps provided by said Sections 2820, 2821, 2822 and 2823 of the said Act hereinabove referred to, that it is the initial view of this legislative body that the contemplated improve- "Ilr v ment described in said Resolution No. 894 , above referred ' to, is one in which the probable assessments will not exceed the limitations set up in Division 4 of the Streets and Highways Code and otherwise known as the "Special Assess- ment Investigation, Limitation and Majority Protest Act of 1931"; That the City Clerk of the City of Carlsbad is hereby directed and ordered to give notice of the contemplated action of this City Council by mailing prepaid post cards giving notice of the finding and proposed action of the City Council, Said card shall be mailed to each person to whom land in the proposed assessment district is assessed on the last equalized county assessment roll available on the date the notices commence, at his or her address as shown upon such roll, and -1- to any person whether owner in fee or having a lien upon, or legal or equitable interest in, any land within the proposed district who has filed with the Clerk his or her name and address and a designation of the land in which he or she is interested. Said notice shall be in the form provided by Part 7 of Division 4 of the Streets and Highways Code of the State of California, otherwise known as the "Special Assessment investigation, Limitation and Majority Protest Act of 1931". PASSED AND ADOPTED by the City Council of the City of Carlsbad at a special meeting held this 26th day of April P 1963 by the following vote, to-wit: AYES : Councilmen McPherson, Bierce, Guevara, Neiswender and Hughes. NOES: None ABSENT :None ATTESTED : City Clerk
