RESOLUTION NO. 914
RESOLUTION FINDING AND DETERMINING THE PERCENTAGE
OF DA!!ANDS BY PR9PERTY OWNERS FOR INVESTIGATION
UNDER THE PROVISIONS OF DIVISION 4 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALXFCRNIA AND DIRECTING THE CITY ENGINEER TO PREPARE A KRITTEN QEPORT OF THE PROPOSED IMPORVEMENTS AND/OR ACQUISITIONS
IWEREAS, after proceedings duly had and taken by Resolution
No, 895 of the Resolutions of the City Council of the City
of Carlsbad, adopted on the 26th day of April , 1963,
and pursuant to the provisions of the "Special Assessment Inves-
tigation, Limitation and ?!ajority Protest Act af 1931", which
is now embodied in Division 4 of the Streets and Highways
of the State of California, this said City Council has determined
and declared that it is the initial view of this city Council
that the improvements contemplated and described in Resolution
No,
Code
913 of the R.esolutions of the City Council, City of
Carlshad, adopted on the 4th day Of June , 1963,
is me in which the probable assessment will not exceed the
limitations set up by said Act; and
WHEREAS, the City Clerk of the City of Carlsbad has given
notice of the contemplated action of the City Council of the
Cit?r of Carlshad in the time, form and manner provided by the
said Act and has made and filed his affidavit showing mailing
of notices in accordance with the provisions of said Act; and
WHEREAS, the 5th day of June , 1963 is the date
fixed in said notice from which the time of the property owners tc
register their opinions and decisions shall run, and more than
thirty (30) days bas expired from and after said last mentioned
date;
NO!:!, TEEREFORE, IT IS HEREBY RESOLVED by the City Council
of the City of Carlsbzd that the nunber of returned postcards,
in response to said notices have been computed and tabulated; tha:
as a result of said computation ar,d tabulation, this City Council

hereby finds and determines that the owners of more than fifteen
(15) percea?t of the area of land proposed to be assessed for
the proposed imporvenent dkscribed in said Resolution No. 913
have demanded the making of the investigation provided for
under the provisions of the "Special Assessment Investigation,
Limitation and 4lajority Protest Act of 1931".
That the City Council further finds that it is desirable
that the City Engineer prepare and present to this Council
a written report of this work in accordance with the provisions
of the "Special Assessment Investigation, Limitation and
Majority Protest Act of 1931", Division 4, of the Streets and
tlighwnys Code od the State of California, and said Engineer is
hereby directed to procure the required information and prepare
and present to the City Council the written report on said work
or improvement required by the said Special Assessment
investigation , Limitation and Majority Protest Act of 1931,
in Sections 2824 through 2830, inclusive, of said Streets
and Highways Code.
