RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD DECLARJHG FINDING THAT OWNERS OF MORE THAN
60% IN AREA OF THE PROPERTY SUBJECT
TO ASSESSMENT IN PROPOSED ASSESSMENT
DISTRICT NO, FOR IMPROVEMENTS; FINDING THAT THE PETITION FOR PROPOSED ASSESSMENT DISTRICT NO. 1-1963 HAS BEEN FILED WITH
THE CJJCRK OF THE CITY OF CARLSBAD;
AND FINDING THAT SAID PETITION CONTAINS A WAIVER OF INVESTIGATION PROCEEDINGS REQUIRED BY DIVISION 4 OF THE STREETS AND HIGHWAY CODE OF THE STATE OF CALIFORNIA,
1-1963 HAVE SIGNED PETITION

WHEREAS, on the 23rd day of September, 1963, a petition was filed with
the City Clerk of the City of Carlsbad, said petition bearing the date of July 19,
196 3, wherein the petitioners requested the improvement of Hemlock Avenue
from the centerline of Garfield Street easterly to the westerly right-of-way line
of the Atchison, Topeka and Santa Fe Railway Company, to construct combined
curb and gutter, concrete driveway approaches, asphaltic concrete pavement
with base and seal coat, and other appurtenant work far permanent street
improvement; and
WHEREAS, the City Engineer of the City of Carlsbad has filed with the
City Council his report stating that owners of more than 60% in area of the
property subject to assessment for such proposed improvement have signed
said petition; and
WHEREAS, it appears from the face of said petition that the signers there4
have waived the investigation proceedings required by Division 4 of the Streets
and Highway Code of the State of California.
NOW, THEREFORE, the City Council of the City of Carlsbad does hereby
resolve and find as follows:
1. That said petition has been filed with the Clerk of the City of Carlsbad
on the 23rd day of September, 1963.
2. That said petition bears the signatures of the owners of more than
60% in area of the property subject to assessment for said proposed improvemer

3. That said petition waives investigation proceedings as required by
Division 4 of the Streets and Highway Code of the State of California.
BE IT FURTHER RESOLVED by the City Council of the City of Carlsbad
that said petition is hereby accepted,
PASSED, APPROVED AND ADOPTED by the City Council of the City of
Carlsbad at a regular meeting held on the 1st day of October, 1963, by the
following vote, to wit:
AYES: Councilmen McPherson, Bierce, Guevara, Neiswender and HugheE
NOES: None
