RESOLWKION OF THE CITY COUNCXL OF THE cmy OF
,cmSBma CALIFOR", DECLARING ITS INTENTION
TO ORDER CERTAIN STREET IMPROVEMENTS AND APPUR-
TENANCES AND APPURTENANT WORK IN SAD CITY; DE-
CLARING THE WORK TO BE OF MORE THAN LOCAL OR
~FUXr."y PUBLIC BENEFIT: DESCRIBING THE DISTRICT
TO BE BENEFITED BY SAID WORK AND TO BE ASSESSED
TO PAY THE COST AND EXPENSE THEREOF; DETERMINING
THAT BONDS SHXLL BE ISSUED TO REPRESENT ASSESS-
MENTS TO BE LEVIED; AND FIXING THE TIME AND PLACE
FOR HEARING PROTESTS AND OBJECTIONS TO SAm WORK
OR THE EXTENT OF THE DISTRICT TO BE ASSESSED, OR
BOTH, AND GIVING NOTICE THEREOF.

The City Council of the City of Carlsbad, California, DOES HER
3Y RESOLVE, DETERMINE AND ORDER as follows:
SECTION 1. That the public interest and convenience require ai

and graded: that the subgrade be prepared and paved with two inches
(2") of asphaltic concrete surface course with chip seal laid upon
four inches (4"'f., of compacted and primed base material; adjustment
of existing sewer manholes and dead ends to grade: Reinforced con-
crete sidewalk underdrains; drainage channel paved with two inches
(2") of asphaltic concrete sruface course: Six inch (6") by six inch
(6") guard post; Portland Cement concrete curb and gutter, side-
walks, driveway approaches, depressed curb sections and alley
approaches be constructed therein; that Portion of Pine Avenue, in
said City, from its intersection with Madison Avenue easterly to its
intersection with the westerly right-of-way of State Highway XI-SD-
2B, be cleared, grubbed and graded; that the subgrade be prepared
and paved with two inches (2"] of asphaltic concrete surface course
with chip seal coat laid upon four inches (4") of compacted and

channel paved with reinforced two inches (2"), of asphaltic concrete
surface course; one hundred and twenty five feet (125") of street
barricade be constructed therein: that the said work hereinbefore
described shall be done to the official grades shown with the exact
nature, extent and location of said improvement to be in accordance
qith detailed plans on file with the City Clerk of the City of Carl
Dad, containing eighteen (18) sheets entitled "Construction Plans
for the Improvement of HAR13ING STREET, Grand Avenue to 50.00 feet
south of the centerline of Magnolia Avenue; OAK AVENUE, 48.00 feet

{which include profiles and detailed drawings) for said work, desig-
nated "Construction Plans for the improvement of HARDING STREET,
Grand Avenue to 50.00 feet south of the centerline of Magnolia Ave-
nue: OAK AVENUE, 48.00 feet west of the centerline of Harding Street
to State Highway XI-SD-2B; PINE AVENUE:, Madison Street to State
Highway XI-SD-2B; CHESTNUT AVENUE, Harding Street to State Highway
XX-SD-2B; PALM AVENUE, 49.29feet west of the centerline of Harding
Street to State Highway XI-SD-2B; MAGNOLIA AVENUE, Jefferson Street
to State Highway XI-SD-2B; SOUTH ONE HALF OF GRAND AVENUE, 48.00 fee

the specifications for said work, which are designated "Contract
flocuments and Construction Specifications No. 2-1962." Said plans
and specifications were heretofore approved by this City Council,
and are on file in the office of the City Clerk of said City in the
City Hall in said City, and reference is hereby made to said plans
and specifications for the full and detailed description of said
proposed work and for a description of the grades at which said work

~JXTIDN 3- That in the opinion of this City Council the said
'ontemplated work is of more than local or ordinary public benefit
.nd this City Council hereby makes the expense of said work chargedbl
pon a district, which district this City Council hereby declares to
e the district benefited by said work and to be assessed to pay the
ost and expense thereof. For a description of said district refer-
rice if hereby made to a plat or map of said district heretofore
pproved and adopted by this City Council, on file in said office of
he said City Clerk and designated "Plat of Assessment District No.
-1962.", which map or plat indicates by a boundary line the extent
f the territory included in the said proposed district and shall
overn for all details as to the extent of said assessment district.
SECTION 4. That serial bonds bearing interest at the rate of
ix per cent &$/.E; per annum shall be issued to represent each assess-
ent of Fifty Dollars ($50.00) or over remaining unpaid for thirty
30) days after the date of recordation of the warrant. Said serial
onds shall extend over a period ending nine (91, years from the sec-
nd day of January next succeeding the next September 1st following
heir date. Said bonds are to be issued pursuant to and as provided
n the Improvement Act of 1911, Division 7 of the Streets and Highway
ode of the State of California, and pursuant to the provisions of
ection 6464 of said Division 7 this City Council hereby elects and
etermines that the redemption provisions of said bonds shall provide
or a premium of five per cent (5%) of the unpaid principal of said
ends to be paid as provided in said Section 6464 and in said Divi-
ion 7.
SECTION 5, That the said proposed work is to be done under and
,roceedings therefor to be under and pursuant to the said mprovement
rct of 1911.

SECTION 6. That notice is hereby given that the 7th day of Jar
uary, 1964, at the hour of 7:30 P.M. is the day and hour whep, and
the Council Chambers of this City Council in the City Hall in said
City Of Carlsbad is the place where, any and all persons having any
protest or objection to said proposed work or to the extend of said
assessment district, or to the proposed grades, may appear before
the City Council of said City and show cause why said proposed work
should not be carried out in accordance with this resolution of in-
tention. Protests or objections must be in writing and must be de-
livered to the said City Clerk not later than the hour herein set
€or hearing protests or objections.
SECTION 7. THE CARLSBAD JOURNAL, a newspaper of general circu-
lation published and circulated in the said City of Carlsbad and in
the County of San Diego, California, is hereby selected as the news-
paper in which this resolution shall be published and, except when
2therwise ordered by this City Council, in which all other publica-
tions in the proceedings pursuant to this resolution of intention
shall be made. The said City Clerk is hereby directed to certify
20 the adoption of this resolution and to cause said resolution to
)e published in the manner provided by law.
SECTION 8. The said City Clerk is hereby directed to mail noti
:es of the adoption of this resolution as provided in said Improve-
nent Act of 1911, postage prepaid, to all persons owning real proper
:y which is proposed to be assessed to pay any part of the cost of
;aid work, whose names and addresses appear on the last equalized
2ssessment roll or as known to the said City Clerk, including the
nailing of such notices to every Owner Of Property assessed by the
state under Section 14 of Article XIS1 of the Constitution at the
