RESOLUTION NO. 96,3.
A RESOLUTION OF TKE CITY COUNCIL
OF THE CITY OF CARLSBAD ANNOUNCING AND DECLARING FINDINGS, AND DENYING THE APPEAL MADE BY RUSSELL L. THIBODO, ET AL, FROM THE DECISION OF THE PLAN- NING COMMISSION CONCERNING A CONDITIONAL
USE PERMIT OF CERTAIN PROPERTY IN THE
CITY OF CARLSBAD,
WHEREAS, there was filed with the City Council an appeal in writing
from the action of the Carlsbad City Planning Commission granting a conditiona
use permit upon certain property within the City of Carlsbad upon the following
grounds, to wit:
(a) That the land under question is in the immediate vicinity of the
flight pattern of Palomar Airport.
(b) That it is near property already zoned M in the City of Carlsbad
and near other land presently unzoned but which is planned to be
developed for light manufacturing use.
(c) The topography of the land to be used for the drag strip is compatibl
for this type of development.
(d) Because of this topography some of the noises and nuisances which
may result will be minimed or confined within this area.
(e) That the planned development is near an east west road called
Palomar Airport Road;
and
WHEREAS, proper notice of a public hearing to be held on December 17,
1963, of said appeal was duly published; and
WHEREAS, said public hearing was held; and
WHEREAS, the City Council did fully hear each and every person who
wished to present evidence and argument upon the subject of the appeal; and
WHEREAS, the City Council did consider all evidence and arguments
presented upon the subject of the appeal;
NOW, THEREFORE BE IT RESOLVED as follows:
1. That the City Council does hereby find that each and all of the
grounds of appeal stated in the said appeal are untrue.

2. That the City Council does hereby find that the action of the Planning
Commission in granting a conditional use permit was reasonable and proper
considering all of the circumstances,
3. That the City Council does hereby approve the action of the Planning
Commission in granting the conditional use permit and does hereby deny the
appeal therefrom.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
City Council held on the 17th day of December, 1964, by the following vote,
to wit:
AYES: Councilmen Bierce, Guevara and Hughes.
NOES Councilman Neiswender
ABSENT: Councilman McPherson
of the City of Carlsbad,
Carlsbad,. CalFTornia
