RESOLUTION NO, 1010
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD ANNOUNCING FINDINGS AND DECISION REGARDING CHANGE OF ZONE CLASSIFICA,TION OF CERTAIN DESIGNATED PROPERTY IN THE CITY OF CARLSBAD FROM ZONE R-1 TO ZONE R-T.
WHEREAS, on the 10th day of March, 1964, the Carlsbad City Planning
Commission adopted Resolution No. 340, which is herewith referred to and
made a part hereof; and
WHEREAS, on April 7, 1964, a duly advertised public hearing was held
as prescribed by law to consider the reclassification from Zone R-l(0ne-family
residential) to Zone R-T (Residential tourist) of property described as:
That portion of Tract 233 of "hum Lands in the City of Carlsbad, County of
San Diego, State of California, according to the Map thereof No. 1681 filed
in the Office of the Recorder of San Diego County December 9, 1915
described as follows:
Beginning at the most Easterly corner of Lot 11 of Harbor Estates according
to the Map thereof No. -3386 filed in the Office of the Recorder of San Diego County March 1, 1956; being a point on the Northeasterly boundary of land
conveyed to E. Thacher by Deed Dated November 16, 1945 and recorded in
Book 2035, Page 81 of Official Records; thence along the boundary of said
Thacher's land, South 284 39' East 436.43 feet, South 72O 25* West 383.84
feet and North 28O 3g2 West 482.75 feet to the most Southerly corner of Lot E of said Harbor Estates; thence along the boundary of said Harbor Estates,
North 61" 21* East 60. 00 feet; thence South 28. 39' 00" East 120.00 feet;
thence North 61" 211 OOIr East 136.70 feet to the point of beginning of a non- tangent 22.50 foot radius curve concave Southwesterly the center of which bears South 61" 21* 00'' West from said point; thence along said curve Southerly, through a central angle of 43* 36* lo*' a distance of 17. 12 feet to
the beginning of a reverse curve forming a cul-de-sac and having a radius oj
50. 00 feet; thence counter clock wise along said curve through a central angle of 267" 12' 20" a distance of 233.18 feet to the beginning of a reverse
curve concave Northeasterly having a radius of 22. 50 feet; thence Northwest
along said curve through a central angle of 43" 36' 10'' a distance of 17. 12 fe
thence North 61" 21* 00" East 120. 00 feet to the point of beginning.
Excepting therefrom, all that portion lying Northerly of the following descril:
line: Beginning at a point on the boundary of said Thacher'*s Land distance
South 28" 39* East 60.00 feet from said most Easterly corner of Lot 11 of
Harbor Estates; thence South 614 21' West 376.70 feet to a point on the
Southerly prolongation of the Westerly boundary of said Harbor Estates,
distance 180.00 feet Southerly from the most Southerly corner of Lot 8 of
said Harbor Estates, said point being the terminus of the described line;
and
WHEREAS, the City Council received all recommendations and heard all
persons interested in or opposed to the proposed change of zone classification.

NOW, THEREFORE, the City Council of the City of Carlsbad DOES
HEREBY DECLARE FINDINGS AND RESOLVE that the findings of the Planning
Commission contained in Resolution No. 340 constitute the findings of the City
Council of the City of Carlsbad.
BE IT FURTHER DECLARED AND RESOLVED that the City Council
certifies that the approval of the proposed change of zone classification is
necessary to carry out the general purpose of Ordinance No. 9060 as amended.
BE IT FURTHEX RESOLVED that the City Council does hereby declare
its intention to adopt an ordinance to effectuate the proposed change of zone
classification.

BE IT FURTHER DECLARED AND ORDERED that the City Attorney is 1

hereby instructed to prepare an ordinance amending Ordinance No. 9060 to
effectuate the change of zone classification.
