A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD ANNOUNCING FINDINGS AND DECISION REGARDING AMENDING SUBSECTIONS (6)(b)(l) AND (6)(b)(2) OF SECTION 500 OF ORDINANCE NO. 9060 REGARDING KEEPING OF HORSES IN R-1 ZONE$
WHERFAS, on the 23rd day of June, 1964, the Carlsbad City Planning
Commission adopted Resolution No. 365, which is herewith referred to and
made a part hereof; and
WHEREAS, on the 21st day of July, 1964, at a duly advertised public
hearing the City Council of the City of Carlsbad considered the Planning Com-
mission's Resolution No. 365; and
WHEREAS, at said hearing the City Council heard all persons interested
in or opposed to the recommendations of the Planning Commission as set forth
in Resolution No. 365; and
WHEREAS, the City Council referred its findings back to the Planning
Commission and requested a further report from the Planning Commission on
the matter; and
VYHEREXS, the Planning Commission did report back to the City Council
that it approved the changes suggested by the City Council;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Carlsbad does hereby find that public necessity, convenience and general
welfare require the amendment of Section 500 of Ordinance No. 9060 as herein-
after stated.
BE IT FURTHER RESOLVED AND DECLARED that the City Council
hereby certifies that the approval of the amendment to Ordinance No. 9060, as
approved by the Planning Commission, is necessary to carry out the general
purpose of Ordinance No. 9060.
BE IT FURTHER RESOLVED that the City Council does hereby declare
its intention to adopt an ordinance to effectuate the change in Ordinance No.
9060.
BE IT FURTmR DECLARED AND ORDERED that the City Attorney is

hereby instructed to prepare an ordinance amending subsection (6)(b) of Section
500 of Ordinance No. 9060 as follows:
ir (b). On each lot or combination of adjacent lots
under one ownership, there may be Wpt one horse for
each 10, 000 square feet in the lot or lots, provided,
however, that any such horse may be kept only if it is
fenced and stabled so that at no time is it able to graze,
stray or roam closer than 50 feet to any building used
for human habitation other than buildings on the said lot or
lots and as to those buildings, no closer than 40 feet. It
PASSED, APPROVED AND ADOPTED by the City Council of the City
of Carlsbad at a regular meeting held on the 15th day of September, 1964, by
the following vote, to wit:
