WHEREAS, on October 29, 1964, a petition was filed with the City
wherein the petitioners requested the Clerk of the City of Carlsbad,
improvement of Madison Street from its intersectim with Elm
Avenue tc; its intersection with Flagncrliz Avenue; Oak Avenue from its
intersection with Roosevelt Street to its intersection with Jefferson
Street; Pine Avenue from its intersection with Roosevelt Street to
its intersection with Madison Street; Walnut Avenue from its inter-
section with Roosevelt Street to its terminus with Alley East of
FZadison Street; Chestnut Avenue from its intersection with Roosevelt
Street to its intersection with Jefferson Street; Palm Avenue from
its intersection with Madisor. Street to its intersection with
Harding Street; Jefferson Street from its intersection with Chestnut
Avenue to its intersection with P~ln Avenue; and Magnolia Avenue
from its intersection with Roosevelt Street to its intersection
with Jefferson Street,
concrete sidewalks, Gombination concrete curb and gutter, ccncrete

improvement have signed said petition; and
WHEREAS, it appears from the face of said petition that the
signers thereof have waived the investigation proceedings required
by Division 4 of the Streets and Highway Code of the State of
California.
NOI.1, THEREFORE, the City Council of the City of Carlsbad does
hereby resolve and find as follows:
1. That said petition has been filed with the Clerk of the
City of Carlsbad on the 29th day of October, 1964,
That said petition bears the signatures of the owners of 2.
more than 60% in area QE the property subject to assessment
for said prapnsed improvement.
3. That said. petition waives investigation proceedings as
required by Division 4 of the Streets and Highway Code of
the State ~f California,
RE IT FURTHER RESOLVED by the City Council of the City of
Carlsbad that said petition is hereby accepted, EXCLUDIXG the
following items of improvement, which will be done by the City of
Carlsbad from the Capitol Improvement Project Tax Funds:
1. Concrete C~QSS gutters and spandrels.
2. Drainage structures and appurtenances thereof.
PASSED, APPROVED AND ADOPTED by the City Council of: tht: City
of Carlrjbad at an adjourr,ed regular meeting held on K~vember 4th,
1964, by the following vote, to wit:
AYES: Councilmen Atkinson, Dunne, Neiswender and Jardine.
NOES: None.
ABSENT: Councilman Hughes.
