RESOLUTION NO. 1098
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD DECLARING FINDING THAT OWNERS OF MORE THAN
60% IN AREA OF THE PROPERTY SUBJECT TO ASSESSMENT IN PROPOSED ASSESSMENT
FOR IMPROVEMENTS; FINDING THAT THE- PETITION FOR PROPOSED ASSESSMENT DISTRICT
OF THE CITY OF CARLSBAD; AND FINDING THAT
VESTIGATION PROCEEDINGS REQUIRED BY DIVISION 4 OF THE STREETS AND HIGHWAY CODE OF THE STATE OF CALIFORNIA.
DISTRiCT NO. 1-1964 HAVE SIGNED PETITION
NO. 1-1964 HAS BEEN FILED HITH THE CLERK
SAID PETITION CONTAINS A WAIVER OF IN-
(Proposed Assessment District No. 1-1964)
WHEREAS, on May 21, 1963, a petition was filed with the City
Clerk of the City of Carlsbad, said petition bearing the date of
October 17, 1961, wherein the petitioners requested the improvement
of the entirety of Stratford Lane, to construct concrete combinatior
curb and gutter, drainage structures and appurtenances thereof 2”
asphaltic concrete pavement with stone chip seal and select sub-base
if needed, 4’ concrete sidewalks, 8” sanitary sewer main with 4”
sewer service 1 ateral s and appurtenances thereof, 6” water main
including fire hydrants and 1” copper services with appurtenances
thereof, and the resetting of fences as needed; and
WHEREAS, the City Engineer of the City of Carlsbad has filed
with the City Council his report stating that owners of more than
60% in area of the property subject to assessment for such proposed
improvement have signed said petition; and
WHEREAS, it appears from the face of said petition that the
signers thereof have waived the investigation proceedings required
by Division 4 of the Streets and Highway Code of the State of Cali-
fornia.
NQld, THEREFORE, the City Council of the City of Carlsbad does
hereby resolve and find as follows:
1. That said petition has been filed with the Clerk of the
City of Carlsbad on the 21st day of May, 1963. City of Carlsbad on the 21st day of May, 1963.

2. That said petition bears the signatures of the owners of
more than 68% in area of the property subject to assessment for
said proposed improvement.
3. That said petition waives investigation proceedings as re-
quired by Division 4 of the Streets and Highway Code of the State of
California.
ND,.ADOPTED by the City Council of the City
of Carlsbad at a regular meeting held on the 2nd day of February,
1965, by the following vote, to wit:
AYES : Councilmen Atkinson, Dunne, Neiswender, Jardine and Hughes.
NOES: None.
ABSENT: None.
