RESOLUTION NO. 1099
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF CARLSBAD, APPOINTING ENGINEER AND FIXING COMPENSATION.

RESOLVED by the City Council of the City of Carlsbad that
WAYNE P. LILL be, and he is hereby appointed Engineer of Work for

all other services which shall be required from the Engineer of Work
and/or Superintendent of Streets under the provisions of the "Improve-
ment Act of 1911"; and

all of the functions provided for the office of Engineer of Work and
Superintendent of Streets in the "Improvement Act of 1911" in con-
nection with the improvement work in the City of Carlsbad, and to be
known as the improvement of the entirety of Stratford Lane; and
BE IT FURTHER RESOLVED that said WAYNE P. LILL shall act as 1 I Engineer of Work and Superintendent of Streets and is hereby employ-
led and appointed to furnish all surveyss original drawings, maps and
/blue prints, including any and all such maps necessary and incident

to the rights of way contemplated in the improvement work herein
involved; all plans and specifications, all inspection work, prepar-
BE IT FURTHER RESOLVED that for such services that the said
Wayne P. LI,LL, acting in his capacity as City Engineer of the City
which compensation shall be payable to the General Fund of the City
of Carlsbad, and shall consl'st of the following sums of money:
(a) Eleven and one-half percent (ll'TJZ%) of the contract price for engineering services.
(b) Two percent (2%) of the contract price for preparation of Assessment, Assessment Roll, Assessment Diagram, and Warrant.
BE IT FURTHER RESOLVED that said sum shall be based upon the
ontract price without incidentals; and in the event the proposed
roceedings herein contemplated shall be defeated or for any reason
ail of consummationg the said Wayne P. Lill of the City of Carlsbac
hall not receive any compensation; and
BE IT FURTHER RESOLVED that the fees hereinabove provided to bi
aid to the said Engineer shall be payable as follows:
(a) Three-fourths (3/4ths) of the Engineering dee upon awarding and signing of contract for the work.
(b) The balance of said Engineering fee, and other fees herein provided for, upon the confirmation of the Assessment and delivery of the Warrant.
PASSED, APPROVED AND ADOPTED by the City Council of the City
if Carlsbad at a regular meeting held on the 2nd day of February,
965, by the following vote, to wit:
AYES : Councilmen Atkinson,Jardine, Neiswender, Dunne and Hughes.
NOES: None.
ABSENT: None.
